Motion
IN THE FEDERAL COURT OF THE COMMONWEALTH OF REDMONT
MOTION FOR EMERGENCY INJUNCTION
Your Honour,
Defendant Smami last logged into the DemocracyCraft server on the 7th of August, 2026 (P-001). She is therefore liable to have her balance pruned beginning on the 7th of November, pursuant to § 15 of the Taxation Act. If the Department of Commerce applies the pruning tax to her before a verdict is reached in this case, Plaintiff may be irreparably harmed by the inability to collect damages from her in the event of a judgment against her.
Plaintiff therefore requests that the Court order the Department of Commerce not to apply the pruning tax to Smami until this case has been adjourned. Plaintiff respectfully requests a swift ruling on this motion.
Case Filing
IN THE FEDERAL COURT OF THE COMMONWEALTH OF REDMONT
CIVIL ACTION
Workers’ Party of Redmont
Plaintiff
v.
Town of Oakridge, Smami
Co-Defendants
COMPLAINT
The Plaintiff complains against the Defendant as follows:
Months ago, the former holder of the Workers' Party's headquarters, Smami, left Redmont for good. On her way out, she transferred the HQ to TrueDarklander, the Secretary-General of the Party. Unbeknownst to anyone else, the plots where the HQ was located had been issued an eviction notice by the Oakridge Residence Office only days before. Smami failed to notify TrueDarklander or any current agent of the WPR of these notices. Days later, the Office evicted the plots from TrueDarklander, despite him meeting all legal requirements for holding the plots, in direct contradiction of Oakridge's bylaws. Still, no agent of the WPR knew of the eviction until the plots had already been auctioned off a month later.
Smami and the Residence Office's actions combined to place the WPR in real danger of losing its headquarters. The eventual winner of the auction demanded $200,000 from the Party in order to retrieve the plots - over double their actual value. During a crucial election season, the Secretary-General and the Central Committee had to make emergency appropriations and fundraise from party members in order to maintain ownership of the headquarters the Party had held for nearly two years.
This entire situation could have been avoided had either Defendant acted in accordance with the law. Smami, by failing to disclose the eviction notices, and Oakridge, by illegally evicting the plots, share equal blame in the very real harm inflicted upon the Party by this series of events. Therefore, the Party petitions this court for compensation of the value of the property, as well as the time, effort, and headache that the Party's leadership was forced to spend and endure due to this incident.
I. PARTIES
1. Workers’ Party of Redmont (Plaintiff)
2. TrueDarklander (Agent of Plaintiff; Secretary-General of Workers’ Party of Redmont)
3. Town of Oakridge (Co-Defendant)
4. asdertplays (Agent of Co-Defendant; Head of Residence of the Town of Oakridge)
5. Smami (Co-Defendant)
II. FACTS
1. On the 6th of August, 2026, Smami transferred the plots of or-c047, or-c055, and or-c056 (“the plots”) to TrueDarklander (P-002, P-003, P-004, P-006). Both held the plots on behalf of the Workers’ Party of Redmont (WPR) for use as that party’s headquarters.
2. At time of transfer, the plots had ongoing eviction notices for lack of playtime.
3. Smami did not inform TrueDarklander or any agent of the WPR of the eviction notices (P-005, P-006).
4. Four days later, on the 10th of August, asdertplays, acting on behalf of the Oakridge Residence Office, evicted the plots from TrueDarklander (P-002, P-003, P-004).
5. TrueDarklander had over six hours of active playtime at the time of seizure.
6. TrueDarklander was not informed that the plots were being seized.
7. On the 24th of August, Deputy Head of Residence Dino_Girl19 listed the plots on a combined auction (thread linked) in the Oakridge Discord (P-008).
8. At 3PM EST on the 1st of September, declarations began for the September 2026 General Elections, in which the WPR participated as part of the United Front (P-009).
8. At 7:12PM EST on the 1st of September, Dino_Girl19 declared Servalot the winner of the auction, with a bid of $90,200 (P-010).
9. Three hours later, TrueDarklander noticed the auction and brought concerns over the legality of the eviction to Dino_Girl19, who opened a government ticket for further communication (P-011).
10. The Town of Oakridge denied that their seizure of the plots was wrongful.
11. The next day, on the 2nd of September, asdertplays fined Servalot $90,200 and transferred the plots to them (P-012, P-013, P-014).
12. Servalot agreed to sell the plots back to the WPR for $200,000 (P-015, P-016).
13. An hour later, the WPR’s Central Committee agreed to the purchase. TrueDarklander paid Servalot from the WPR in-game DB, and the plots were transferred back (P-017, P-018).
14. On the 8th of September, TrueDarklander and the WPR filed suit (thread linked) against Smami and the Town of Oakridge over the underlying incident.
15. On the 2nd of November, the Honourable Judge Talion77 dismissed the case (post linked) without prejudice so that the Plaintiffs could refile under new counsel.
III. CLAIMS FOR RELIEF
1. Smami failed to disclose that the plots were under an active eviction notice.
RCCA VII § 2:
Part III, § 15(3) of the Property Standards Act requires the original owner of a plot to notify the recipient of any active eviction reports or violations on that plot when it is transferred. By failing to do so when transferring the WPR HQ to TrueDarklander, Smami committed Failure to Disclose under the RCCA, and denied the WPR the ability to contest the eviction report, ultimately resulting in an unnecessary loss of $200,000. Plaintiff contends that Smami is liable for 50% of that value, subject to treble damages.Failure to Disclose
Violation Type: Negligent/Strict Liability
Remedy: Treble damages
A person commits a violation if the person:
(a) fails to provide the other parties with all legally required information and/or documents which are relevant to a property.
2. The Residence Office lacked lawful authority to seize the plots after they had been transferred.
RCCA IX § 4:
Regardless of the WPR’s knowledge or lack thereof of the eviction report, the Head of Residence lacked lawful authority to seize the plots from TrueDarklander on the 10th of August. Article II, § 6 of the Oakridge Building Regulations state:Wrongful Seizure of Property
Violation Type: Intentional/Negligent
Remedy: Restitution
A person commits a violation if the person:
(a) being a government officer, seizes property without lawful authority; or
(b) being a government officer, retains property beyond a period authorised by law.
This violation shall not occur where:
(c) the seizure was conducted pursuant to a valid court order or lawful statutory power
Because the Regulations state that ownership is solely determined by in-game plot ownership, the owner of the plots for the purpose of § 6 on 10 August was TrueDarklander. At that time, TrueDarklander was not deported, and as a Senator, he was constitutionally required to maintain at least 12 hours of active playtime (Const. I § 9(3)). We can therefore be certain that he surpassed the 6 hour playtime requirement to hold the plots. While § 15(2) of the Property Standards Act does state that the transfer of a plot does not affect the date of eviction in reference to a report, the authority for the land use and building regulations lies with the Towns (Const. § 32(3)), as affirmed by the DCT in their Town Relations policy. The Building Regulations’ wording is therefore controlling: an eviction under Part II § 6 is only valid if the in-game owner of the plot is deported or does not meet 6 hours of active playtime. Neither of these applied to TrueDarklander at the time of eviction, and neither the Regulations nor the PSA provide another avenue for legal eviction. Therefore, the Town illegally seized the property, ultimately resulting in the WPR having to spend $200,000 to repurchase it. Plaintiff contends that Oakridge is liable for 50% of that value.(6) Inactivity Policy
1. Any player who has less than 6 hours of playtime in the last 30 days, or is permanently banned/deported, shall be evicted from their plots after being given no less than 1 week notice by the Town of Oakridge.
2. For the purpose of this section, ownership is solely determined by the player who holds the plot in question in game.
IV. PRAYER FOR RELIEF
The Plaintiff seeks the following from the Defendant:
1. $300,000 in compensatory damages from Smami.
Plaintiff contends that the Town of Oakridge and Smami are equally liable for the eventual loss of $200,000 suffered by the WPR as a result of the loss of the plots, because if either Defendant had fulfilled their duties before the law, the plots would almost certainly not have been seized. Smami is therefore liable for half the value of the plots, or $100,000, subject to treble damages as granted by the RCCA’s tort on Failure to Disclose.
2. $100,000 in compensatory damages from the Town of Oakridge.
The remaining half of the value of the plots that WPR had to repurchase.
3. $100,000 in consequential damages from the Town of Oakridge.
The WPR was only eventually made aware of the loss of the plots on the 1st of September, the same day that the September General Elections were declared. The ensuing scramble to retrieve the plots required the use of time and effort that would have otherwise been spent on campaign efforts, and the hastily put-together $200,000 payment would have otherwise gone to campaign expenses for the United Front. This severely affected the WPR’s ability to conduct its normal operations, and therefore represents significant consequential harm. This prayer is not requested against Defendant Smami due to their likely inability to pay it in addition to other damages if granted—a judgment against her on that prayer would be essentially moot.
4. $150,000 in punitive damages from the Town of Oakridge.
Not only did the Residence Office fail to do its due diligence in checking the legal owner of the plots before evicting them, it also failed at multiple stages to reduce harm, when it had the full ability to do so. Had the Residence Office notified TrueDarklander of the eviction, he could have asserted his Right of Redemption under the Oakridge Building Regulations (Art. IV § 2). Even after being contacted and informed that the evictions were illegal, the Town government refused to reverse the eviction, take any compensatory action, or even take accountability, instead insisting that the blame lay fully with Smami. This is outrageous behaviour for a local department charged explicitly with knowing and fairly enforcing the bylaws of Oakridge.
5. Legal fees equal to one third of the damages awarded from each Defendant.
