Amend the
Criminal Code Act

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the 'Town Offences Act'
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored and proposed by Representative RealImza.
(5) This Act has been co-sponsored by Representative Talion77.

2 - Reasons
(1) With the passing of this Criminal Code Act, all town offences passed by the relevant town legislatures became null and unenforceable.
(2) Allowing towns to create their own crimes would enhance town autonomy and criminal RP.
(3) This act aims to do that.

3 - Amendment
(1) Part I, Section 3 of the Criminal Code Act shall be amended as follows:
"
3 - Codification of Criminal Law
(1) This Code constitutes the exclusive and exhaustive listing of criminal offences within the jurisdiction of Redmont.

(2) No person may be charged with a criminal offence unless that offence is contained within this Code.

(3) Any new offence that seeks to impose a fine or imprisonment must be introduced as an amendment to this Code.

(4) Subsections 2 and 3 shall not apply to towns. Towns may establish both summary and indictable offences within their jurisdiction, including associated fines, penalties, and imprisonment.

(5) The town’s authorities, as defined in a town’s constitution or bylaws, shall carry out enforcement or prosecution of town-level offences.
(a) Summary offences may be enforced locally by the town’s authorities. Town authorities may delegate the enforcement of Town summary offences to the Department of Homeland Security.
(b) Indictable offences established by a town shall be prosecuted in the relevant federal courts, with the town’s designated legal office acting as the prosecuting authority.

(6) A Town may not criminalise compliance with federal law;

(7) Towns may not create offences that have been explicitly pre-empted by federal legislation.

Aye, this bill furthers town rights, and expands the purpose of roles like Oakridge sheriff.
 
Nay, towns should be able to make decisions regarding local issues, such as local infrastructure and local building policy. What is and is not a crime is not a local issue. Besides that, it will make it extremely complicated to know what is and isn't illegal in which location for new players.
