COMMONWEALTH OF REDMONT




A BILL TO

AMEND THE CRIMINAL CODE ACT TO PROTECT WILDERNESS TRADE




The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

PART I — PRELIMINARIES

1. Short Title and Enactment

(1) This Act may be cited as the ‘Wilderness Trade Protection Act’

(2) This Act shall be enacted immediately upon its signage.

(3) This Act has been authored by Representative EATB.

(4) This Act has been co-sponsored by Representative MJL_ and Representative Stanley582.

(5) This Act amends the following acts:
(a) Criminal Code Act

2. Reasons and Intent
(1) Under the International Community Framework Act, the Wilderness is legally classified as an International Zone.

(2) The current wording of "Unrecognized Foreign Exchange" and "Foreign Exchange Fraud" under the Criminal Code Act targets financial transactions involving unrecognized or recognized foreign entities, states, or servers.

(3) Because the Wilderness is classified as international territory, there is a severe risk of legal ambiguity where trade, loans, or investments involving unregistered wild polities, could be prosecuted as illegal cross-server foreign exchange.

(4) This Act resolves this ambiguity by establishing explicit exceptions, ensuring that all trade conducted with players, communities, and polities inside Redmont's Wilderness worlds is completely protected, while keeping the ban on actual unauthorized cross-server trading intact.

PART II — AMENDMENTS TO THE CRIMINAL CODE ACT

(1) Part VII, Section 21 and Section 22 of the Criminal Code Act shall be amended as follows:

"21 - Unrecognized Foreign Exchange
Offence Type: Indictable
Penalty: Up to 200 Penalty Units; Up to 60 minutes imprisonment
A person commits an offence if the person:
(a) being a registered Financial Institution:
(i) transfers or lends any money, real estate, company shares, financial instruments, or items, in exchange for or collateralised with foreign assets originating from an entity or state (server) unrecognized by the Commonwealth of Redmont; and
(ii) this is either directly or by a proxy intermediary involving other companies or players.
This offence shall not occur where:
(b) the transaction, transfer, or exchange is conducted with an individual, community, or registered polity operating within the Wilderness, Everwild, Nether, or End.

22 - Foreign Exchange Fraud
Offence Type: Indictable
Penalty: Up to 200 Penalty Units; Up to 60 minutes imprisonment
A person commits an offence if the person:
(a) transfers or lends any money, real estate, company shares, financial instruments, or items, in exchange for or collateralised with assets originating from a foreign entity or state (server) recognised by the Commonwealth of Redmont; and
(b) the transfer was for a price well below its market rate (recent average exchange rate prices within bounds advised by Department of Commerce, subject to periodic review); and
(c) it was through misrepresentation, fraudulent intent, or any other criminal intent as enumerated by law.
This offence shall not occur where:
(d) the transaction, transfer, or exchange is conducted with an individual, community, or registered polity operating within the Wilderness, Everwild, Nether, or End.

NAY - Uh, how does this keep the ban on unauthorized foreign currency? All this does is add an exception that allows individuals, communities or polities operating within the wild to do this, but once it’s done in the wild, it can easily just be brought into Redmont. Also how does the wild count as it’s highly questionable if the ICFA will hold for much longer. Setting all that aside, I find it questionable to argue that Redmontian citizens operating within the wild will be considered foreign entities to begin with.

Anyways, this will probably get staff veto’s either way. If it doesn’t, there are less destructive ways to solve what we are trying to do here assuming the arguments the bill presents even holds.
 
:nay: - While I understand the sentiment behind this law, there are too many cans of worms being opened upon deeper consideration of these changes. I encourage congress to re-review this to come back with a law that has additional safeguards for any misuse.
