Motion
IN THE FEDERAL COURT OF THE COMMONWEALTH OF REDMONT
EMERGENCY INJUNCTION
The Plaintiff in the upcoming proceeding requests an Emergency Injunction ordering the immediate release of Vernicia from prison and temporarily suspending the enforcement of her remaining sentence pending the resolution of this case.
On September 30, 2026, DHS obtained an arrest warrant against Vernicia, which was executed on October 12, 2026, outside the 10-day service window established by the Judiciary's Court Orders Guide.
As a result, Vernicia has been sentenced to 21 hours of imprisonment and currently has around 6.5 hours remaining on this sentence. Every minute served cannot be restored should the Plaintiff be successful.
We are challenging the legality of the warrant's execution under Part XI, Section 1 and Section 5 of the Redmont Civil Code Act and Part V, Section 35 of the Constitution.
In [2025] DCR 93, the Court granted temporary relief preventing DHS from enforcing imprisonment while the case was ongoing; we ask for that as well.
Thank you,
