CONGRESS OF THE
COMMONWEALTH OF REDMONT




A BILL TO

AMEND THE NATIONAL BORDERS ACT TO CLARIFY TOWN ESTABLISHMENT




The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

PART I — PRELIMINARIES

1. Short Title and Enactment


(1) This Act may be cited as the ‘Town Establishment Clarification Act’

(2) This Act shall be enacted immediately upon its signage.

(3) This Act has been authored by Representative EATB.

(4) This Act has been co-sponsored by President of the Senate Talion77.

(5) This Act amends the following acts:

(a) National Borders Act

2. Reasons and Intent

(1) The Constitution was amended by the Town Rights Expansion Act, which explicitly states that towns "may be established or dissolved only by an amendment to this Constitution. No Town may be dissolved by Executive action nor by ordinary statute".

(2) Section 3 of the ordinary statute National Borders Act currently purports to authorise the President to establish a town within the Reveille Isles unilaterally.

(3) This statutory provision directly contradicts the Constitution, creating an unconstitutional delegation of power and unnecessary legal ambiguity regarding executive authority over local governments.

(4) This amendment repeals Section 3 of the National Borders Act to align our statutory laws with the Constitution, and renumbers the remaining sections accordingly.

PART II — AMENDMENTS

3. Amendments to the National Borders Act


(1) Section 3 of the National Borders Act is hereby repealed in its entirety:

"3 - Terms
(1) The President is authorised to establish a town/city in the Reveille Isles."


(2) Section 4 of the National Borders Act shall be renumbered and amended as follows:

"4 - Geography 3 - Geography

(1) Redmont
(a) Redmont is characterised as an archipelagic nation consisting of the Reveille Isles.
(b) The capital city of Redmont is the City of Reveille.

(2) Reveille Isles.
(a) The Reveille Islands serve as the mainland of Redmont and host the nation's capital, Reveille. Reveille is located on the southern two islands with smaller settlements to the north."
 

Presidential Assent


This bill has received Presidential assent and is hereby signed into law.

Reason: Section 3 of the National Borders Act enabled the President to establish a town through statute, conflicting with the Constitution's rule that towns may only be created or dissolved by Constitutional Amendment.

This Bill repeals that provision to align the statute with the Constitution.
