COMPLAINT

The Plaintiff complains against the Defendant as follows:

WRITTEN STATEMENT FROM THE PLAINTIFF

At around 00:10 UTC+1, I was peacefully lying on the floor minding my own business when the defendant, Culls, deliberately came over to me and began stepping and jumping on my person. This was an unprovoked attack that caused me distress and humiliation. The defendant's own statements in chat, saying "i'm stepping on toad" and "[crush] him," clearly demonstrate the intentional and malicious nature of this assault. As someone who is not the normal height of a regular player, this experience was particularly degrading and made me feel belittled and upset. The defendant's actions were completely unwarranted and constitute both assault and disturbing the peace.

II. FACTS
1. On or around 00:10 UTC+1, Plaintiff was peacefully lying on the floor, causing no harm or disturbance to anyone.
2. Defendant deliberately approached the Plaintiff's location.
3. On or around 00:39 UTC+1, Defendant then intentionally stepped on and jumped on the Plaintiff's person without consent or provocation. (P-001)
4. Defendant made statements in chat, including "i'm stepping on toad" and "[crush] him," (P-001)
5. Plaintiff is not the normal height of a regular player, making this conduct particularly humiliating. (P-002)
6. Defendant is of the normal player height, creating a significant size disparity. (P-003)
7. As a result of Defendant's actions, Plaintiff suffered emotional distress, humiliation, and felt belittled and upset.
8. Defendant's conduct was unprovoked, intentional, and served no legitimate purpose.

III. CLAIMS FOR RELIEF
1. Assault - In violation of Part IV, Section 1 of the Criminal Code Act, Defendant intentionally placed Plaintiff in a position of danger by stepping and jumping on them, constituting assault under the law.
2. Disturbing the Peace - In violation of Part V, Section 1 of the Criminal Code Act, Defendant engaged in disorderly behaviour toward Plaintiff that caused harassment, alarm, and distress.
3. Consequential Damages for Humiliation - Under Section 7 of the Legal Damages Act, Plaintiff suffered humiliation damages as they were disgraced, belittled, and made to look foolish by Defendant's conduct.

IV. PRAYER FOR RELIEF
The Plaintiff seeks the following from the Defendant:
1. Compensatory damages in the amount of $1,000 for the emotional distress and harm caused.
2. Consequential damages for humiliation in the amount of $2,000 under the Legal Damages Act.
3. An order requiring Defendant to cease and desist from any further harassment or assault of Plaintiff.
4. $300 in legal fees and costs as provided by law.

Writ of Summons

@Culls, is required to appear before the District Court in the case of Toadking v. Culls [2025] DCR 57

Failure to appear within 72 hours of this summons will result in a default judgement based on the known facts of the case.

Both parties should make themselves aware of the Court Rules and Procedures, including the option of an in-game trial should both parties request one.
