COMPLAINT
The Plaintiff complains against the Defendant as follows:

On April 4th, 2024, the plaintiff and defendant entered into an agreement where the plaintiff would undertake the reconstruction of the defendant's house, and in return, the defendant would remit $50,000 plus material expenses. After the completion of the project the defendant requested the plaintiff's Discover account information, which was provided. When the plaintiff inquired about the payment status the following day, the defendant responded that the bank may take up to three days to process the transaction. Days later, upon further inquiry, the defendant claimed to have been deported for a duration of three months. Despite ongoing efforts, the plaintiff has been unable to secure the rightfully owed payment.

II. FACTS

1. On April 4th, 2024, the plaintiff and defendant entered an agreement wherein the plaintiff would undertake the reconstruction of the defendant's home in exchange for $50,000 plus material costs.

2. After the plaintiff provided their Discover banking information to the defendant, the latter claimed that it would take three days to complete the money transfer.

3. Despite the plaintiff's attempts to receive payment, the defendant informed them of being banned for a period of three months.

4. The defendant continuously evaded questions about payment by referencing funds in their company account and personal bank account.

III. CLAIMS FOR RELIEF
1. Breach of Contract: The defendant's failure to uphold the terms of the agreement with the plaintiff constitutes a breach of contract, leading to financial losses for the plaintiff.

2. Loss of Enjoyment: The plaintiff suffered significant financial losses due to the breach, compounded by the time and resources invested in rebuilding the defendant's home without receiving rightful compensation. The IRL time put into this project with no pay is clear loss of enjoyment in Redmont.

3. Opportunity Cost: Had the plaintiff received the promised payment, they intended to invest it in the SC Bank, which offers a lucrative 5% monthly interest rate. Due to the non-payment, the plaintiff has been deprived of this opportunity, resulting in further financial detriment. This loss of income exacerbates the plaintiff's financial hardship, stemming from the lack of compensation for their work.

IV. PRAYER FOR RELIEF
The Plaintiff seeks the following from the Defendant:

1. Breach of Contract: The plaintiff demands the original sum of $50,000 as agreed upon for the completed work.

2. Compensation for Loss of Enjoyment: The plaintiff endured hours of labor reconstructing the house without receiving compensation, resulting in a loss of enjoyment. Accordingly, we seek $5,000 in damages to rectify this loss.

3. Punitive Damages: The defendant's reprehensible conduct, including attempting to evade payment by claiming deportation falsely saying the bank takes 3 days and not attempting to have staff move the money, warrants punitive damages. We seek $3,000 as a punitive measure.

4. Compensatory Damages: The financial loss of $50,000, which could have been invested in an account earning 5% monthly interest, amounts to approximately $83 per day since April 4th, 2024. As of today, this loss has accrued to $664. We seek this amount, along with an additional $83 for each day that this case remains in session.

5. Legal Fees: Pursuant to standard practice, we request legal fees amounting to 30% of the case's value, to cover the costs incurred in pursuing this matter.

By making this submission, I agree I understand the penalties of lying in court and the fact that I am subject to perjury should I knowingly make a false statement in court.

WRIT OF SUMMONS


@5axe is required to appear before the Federal Court in the case of the_superior10 v. 5axe.

Failure to appear within 72 hours of this summons will result in a default judgement based on the known facts of the case.

Both parties should make themselves aware of the Court Rules and Procedures, including the option of an in-game trial should both parties request one.​
 
Seeking as the Defendant is banned, the court will be in recesses until a Public Defender is appointed.
