Amend the Standing Orders to Include a Non-Exhaustive List of Motions
RESOLVED by the Council of Aventura:
1 - Short Title
(1) This Resolution may be cited as the 'Second Standing Orders Motion Amendment Resolution.'
(2) This Resolution has been authored by Julia Tempest.
2 - Reasons
(1) Under the current Standing Orders, there is no list of motions because the Speaker forgot to include them.
3 - Amendments
(1) Section I of the Standing Orders of the Council of Aventura shall be amended as follows:
(a) Any Councillor may move for a motion.
(i) This Bill shall be posted within the Aventura Council forum.
(ii) This Bill shall follow the format for Bills as provided by the Speaker.
(iii) This Bill shall have at least one sponsor.
(iv) Additional individuals may sponsor a Bill.
(v) A non-exhaustive list of motions may be found on Appendix A.
(2) The following appendix shall be added to the Standing Orders of the Council of Aventura:
- Motion to Remove:
- A member of the council may propose a Motion to Remove to remove any officer from their office for any reason the council deems necessary. If passed, the office of the target shall be declared vacant, and the constitutionally mandated steps shall be taken to fill the office once more.
- To pass, the concurrence of a supermajority (2/3rd) of all sitting council members, excluding those with a conflict of interest, is required.
- Motion to Censure:
- A member of the council may propose a Motion to Censure to condemn the actions of any individual. A censure shall not impose penalties but shall serve as a formal reprimand.
- To pass, the concurrence of a simple majority of all sitting council members, excluding those with a conflict of interest, is required.
- Motion to Amend:
- A member of the council may propose a Motion to Amend to a bill that is undergoing the legislative process. A motion to amend may not be filed if a bill has already passed. If passed, the legislative process for the bill, including all previous votes, shall be reset.
- To pass, the concurrence of the same majority required for passage of the amended bill in the council is required.
- Motion to Override Veto:
- A member of the council may propose a Motion to Override Veto to override a veto issued by the Mayor.
- To pass, the concurrence of a supermajority (2/3rds) of all sitting council members, excluding those with a conflict of interest, is required.
- Motion of No Confidence:
- A member of the council may propose a Motion of No Confidence to withdraw the Council's confidence in the Speaker. If passed, the Office of the Speaker shall be declared vacant.
- To pass, the concurrence of a simple majority of all sitting council members, excluding those with a conflict of interest, is required.
- Motion to Commend:
- A member of the council may propose a Motion to Censure to commend the actions of an individual. A censure shall not impose penalties but shall serve as a formal reprimand.
- To pass, the concurrence of a simple majority of all sitting council members, excluding those with a conflict of interest, is required.
- Motion to Suspend the Rules:
- A member of the council may propose a Motion to Suspend the Rules to suspend particular sections of the Standing Orders for a specific duration. Rules pertaining to voting may not suspended.
- To pass, the concurrence of a simple majority of all sitting council members is required.
- Motion to Appeal the Ruling of the Chair:
- A member of the council may propose a Motion to Appeal the Ruling of the Chair to formally appeal any ruling made by the Chair during the session.
- To pass, the concurrence of a simple majority of all sitting council members, excluding those with a conflict of interest, is required.
