CONGRESS OF THE
COMMONWEALTH OF REDMONT

A BILL TO

AMEND THE CONSTITUTION

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

PART I - PRELIMINARIES

1. Short Title and Enactment

(1) This Act may be cited as the ‘Presidential Requirements Amendment Act’.

(2) This Act shall be enacted immediately upon its signage and constitutional passage by referendum.

(3) This Act has been authored by Electoral Officer EATB.

(4) This Act has been co-sponsored by Senator Lxi404.

(5) This Act amends the following acts:

(a) Constitution of the Commonwealth of Redmont

2. Reasons and Intent

(1) The Constitution's provisions regarding the Presidential requirements for office were intended to limit an individual from serving consecutive terms as President, to prevent the consolidation of power and promote healthy democratic turnover.

(2) Under current constitutional law, the term limit applies only to the "previously elected President."

(3) This wording creates a loophole where a Vice President can ascend to the Presidency due to a resignation, take office, due to presidential succession, serve the vast majority of the term as President, and still legally run for President in the subsequent election, potentially allowing an individual to hold the Presidency for up to 8 continuous months.

(4) Similarly, a President could go on a Leave of Abscence, and a Vice President can excessively take over as Acting President and then also be eligable to re-election.

(5) This amendment closes this loophole by disqualifying any individual who has held the Office of the President in acting or official capacity for more than 30 days in the immediately preceding term from running for President and Vice President.

PART II - AMENDMENTS TO THE CONSTITUTION

3. Amendments to Section 25, Subsection 2, and Section 27, Subsection 2

(1) Section 25. Election, Subsection (2) of the Constitution of the Commonwealth of Redmont shall be amended as follows:

(2) Presidential Requirements. In order to run for the office of President of Redmont, a citizen must meet these requirements:
  • Has 12 hours of active playtime in the last 30 days.
  • Has been 4 months since the player’s initial join date.
  • Has accrued 300 hours of active playtime.
  • A Presidential candidate cannot be the previously elected President.
  • A Presidential candidate cannot have held the office of President via succession or in acting capacity for more than 30 days during the term immediately preceding the term for which the election is being held.

(2) Under Section 27. Vice President, Subsection (2) of the Constitution of the Commonwealth of Redmont shall be amended as follows:

(2) Vice Presidential Requirements. In order to run for and maintain the office of Vice President of Redmont, a citizen must meet these requirements:
  • Has 12 hours of active playtime in the last 30 days.
  • Has been 4 months since the player’s initial join date.
  • Has accrued 150 hours of active playtime.
  • A Vice Presidential candidate cannot be the most recently elected President.
  • A Vice Presidential candidate cannot have held the office of President via succession or in acting capacity for more than 30 days during the term immediately preceding the term for which the election is being held.
PART III: IMPLEMENTATION
4. Implementation

(1) The Office of Congressional Affairs is authorized to make any changes involving renumbering of sections as a result of edits made in this Act.

The Presidential Requirements Amendment Act closes a loophole in the Constitution’s term limit for President. At the moment the limit applies only to the “previously elected President”. A Vice President who takes over through succession, or who acts for a long Leave of Absence, can serve most of a term and then run again. That could mean up to about 8 continuous months in office.

The bill disqualifies anyone who held the Presidency by succession or in an acting capacity for more than 30 days in the preceding term. That person could not run for President or Vice President. It is a fair rule, because a short stint covering a brief absence does not count, and only real, extended time in office does.

Overall, this is a sensible and well-targeted fix that protects healthy democratic turnover without punishing short, genuine cover periods.

I thank Electoral Officer EATB for authoring this bill, Senator Lxi404 for cosponsoring it, and Congress for passing it.

This bill has been granted assent. As a constitutional amendment, it now proceeds to referendum under Section 36 of the Constitution.
