Better Regulate Conduct of Lawyers
The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:
1 — Short Title and Enactment
(1) This Act may be cited as the "Modern Legal Reform (Conduct Strikes) Act".
(2) This Act comes into effect immediately upon receiving the President’s signature.

2 — Reasons
(1) At present, it is nigh impossible to disbar someone for repeated malfeasance in Court;
(2) Judicial Officers would like for disbarring to not be so hard, and it is the sense of Congress that disbarring should not be so hard;
(3) In the past, a bar association has been abused, and so objective standards are needed for disbarment.
3 — Conduct strikes
(1) A judicial officer may issue a conduct strike to a lawyer when the judicial officer—
- Convicts a lawyer of Perjury; or
- Convicts a lawyer of Contempt of Court; or
- Convicts a lawyer of Frivolous Court Case; or
- Convicts a lawyer of any other crime arising from a lawyer's actions in Court.
(3) A conduct strike applies in addition to any penalty imposed for the underlying conduct (for example, a fine).
(4) A conduct strike expires three months from the day it is issued.
4 — Suspension on third strike
(1) A lawyer must be suspended for the period specified in subsection (2) when—
- the lawyer has been issued two conduct strikes that have not expired; and
- the lawyer is issued a third conduct strike.
- for a first suspension, one month;
- for a second suspension, two months; or
- for a third or subsequent suspension, three months.
- is temporarily disbarred for the purposes of section 3(2) of the Modern Legal Reform Act; but
- may continue to practice law in any case where the lawyer filed an appearance before being issued a third conduct strike.
(1) A lawyer who is suspended under section 3 may petition the Supreme Court for review of their suspension.
(2) The Supreme Court may adopt rules for the handling of petitions under this section.
(3) When considering a petition under this section, the Supreme Court must consider—
- the circumstances of each conduct strike, and whether each conduct strike was justified by reference to the underlying conduct and section 2(2); and
- the lawyer's conduct generally; and
- the importance of maintaining the reputation of the legal profession; and
- such other matters as the court thinks fit.
- decline the petition; or
- cancel one or more of the lawyer's conduct strikes and reinstate the lawyer; or
- reduce the suspension by any period the court considers appropriate.
6 — Department of Homeland Security must keep records
(1) The Department of Homeland Security must keep a record of—
- every conduct strike issued under section 3;
- every suspension imposed under section 4; and
- every review considered under section 5.
