Bought a property on a “new players loan” where the bank own it until i can pay it off and during me paying it back the bank owner who held the property went inactive and the property was evicted. I tried to contact the bank owner right when my things went vaulted but he didnt respond
I. PARTIES
1. The Plaintiff, Jojofortnite, is a citizen of the Commonwealth of Redmont and the purchaser of plot C164 under a mortgage arrangement with VDRB Bank.
2. The Defendant, VDRB Bank, is the financial institution through which the Plaintiff purchased the property.
II. FACTS
1. The Plaintiff entered into a mortgage arrangement with the Defendant for the purchase of plot C164.
2. Under this arrangement, the Defendant retained legal ownership of the property while the Plaintiff made payments towards its purchase. Ownership was intended to transfer to the Plaintiff upon repayment of the loan.
3. During the mortgage period, the property's registered owner, fickogames, became inactive.
4. On or around September 29, 2026, plot C164 was evicted due to the registered owner's inactivity, and the Plaintiff's possessions were vaulted.
5. Following the eviction, ownership of C164 was transferred to the Department of Construction and Transportation.
6. Following the eviction, the Plaintiff attempted to contact representatives of the Defendant regarding the loss of C164. Although fickogames acknowledged the matter and indicated that he would contact the Department of Construction and Transportation, the property has not been restored.
7. The Plaintiff subsequently sought assistance from the Department of Commerce regarding the loss of the property.
8. Despite these efforts, the property has not been returned to the Plaintiff.
9. On October 9, 2026, a representative of the Department of Construction and Transportation confirmed that C164 was under government control and would be placed up for auction.
10. As a result, the Plaintiff remains deprived of the property for which he entered into the mortgage arrangement, while C164 is at risk of being sold to a third party.
11. The Plaintiff purchased C164 for $150,000 under the mortgage arrangement with the Defendant.
III. CLAIMS FOR RELIEF
1. Breach of Contract
1. Section 7(1) of the Contracts Act provides that a breach of contract occurs when a party fails to fulfil its contractual obligations.
2. Part VI, Section 1 of the Redmont Civil Code Act further establishes liability where a party fails to perform its obligations under a valid and enforceable contract without lawful excuse.
3. The Plaintiff entered into an agreement with the Defendant for the purchase of C164, under which the bank retained ownership pending repayment.
4. The Defendant's failure to maintain the property during this period resulted in its eviction and prevented the Plaintiff from obtaining ownership in accordance with the arrangement.
5. The Plaintiff submits that the loss of the property constitutes a failure by the Defendant to fulfil its contractual obligations, for which the Plaintiff is entitled to relief.
2. Equitable Relief
1. The Plaintiff's primary interest is in recovering C164, which is presently held by the Commonwealth (GovDevelop).
2. The anticipated auction of C164 threatens to place the property in the hands of a third party before the rights of the parties can be determined.
3. The Plaintiff submits that preserving the property pending resolution of this dispute is necessary to prevent further harm and ensure that effective relief remains available.
IV. PRAYER FOR RELIEF
The Plaintiff seeks the following from the Defendant:
1. An order restoring plot C164 to the ownership arrangement existing before its eviction, with the Plaintiff retaining his rights under the mortgage agreement.
2. In the alternative, should restoration of the property be impracticable, damages against the Defendant representing the Plaintiff's proven financial losses arising from the breach.
3. Legal fees to the full extent of the law.
4. Any further relief as the Court deems just.
V. EVIDENCE
VI. WITNESSES
1. Jojofortnite
2. fickogames
By making this submission, I agree I understand the penalties of lying in court and the fact that I am subject to perjury should I knowingly make a false statement in court.
