The Plaintiff complains against the Defendant as follows:
WRITTEN STATEMENT FROM THE PLAINTIFF
I. PARTIES
1. HavenCham (Plaintiff)
2. Frog_Bro_ (Defendant)
II. FACTS
1. On 2026-10-28 at 21:30:02 UTC, the Defendant started a Discord Auction in #marketplace for the following items (P-001, P-002), constituting Offer and Intent under the Contracts Act:
- Netherite Helmet Prot IV Unb 3 Mending
- Netherite Chestplate Projectile Prot IV Unb 3 Mending
- Netherite Leggings Prot IV Unb 3 Mending
- Netherite Boots Projectile Prot V Unb 3 Mending
- Elytra Unb 3 Mending
- Sword Sharp V, Sweeping III, Fire Aspect II Unb 3 Mending
- Netherite Pickaxe Fortune III Unb 3 Mending Effi 5
- Netherite Axe, Sharpness V Silk Touch Efficiency V Unb 3 Mending
- 3 stacks of duration 1 fireworks + 55
- 40 37 steak
- 1 copper drill
- 64+35 exp bottles
- 3 haste III potions, 3 Speed II potions
- 52 netherite ingots
- Turtle Shell Helmet
2. On 2026-10-29 at 00:59:48 UTC, the Plaintiff posted the winning bid of 15k constituting Acceptance and Intent under the Contracts Act. (P-003)
3. On 2026-10-31 at 01:05:02 UTC, the Plaintiff sent $15,000 to the Defendant through discord /pay, constituting Consideration under the Contracts Act. (P-003)
4. On 2026-11-01 at 18:58:50 UTC, the Defendant sent a Shulker Box to the Plaintiff through the mail system. (P-004)
5. On 2026-11-01 at 19:00:10 UTC, the Defendant started a Discord Auction for the missing 52 netherite ingots. (P-005)
6. At approximately 2026-11-01 19:22:26 UTC, the Plaintiff received the Shulker Box through the mail system, and realized that the most valuable items were missing and some additional items (6 potions) were added to make the shulker appear full. (P-006, P-007)
The following were missing:
- 52 netherite ingots.
- 1 Elytra with unbreaking 3 and mending.
- 1 Copper drill.
- 8 duration 1 fireworks.
- 3 steaks.
- 3 haste III potions.
- 3 Speed II potions.
7. At approximately 2026-11-01 21:10 UTC, the Plaintiff mailed back the additional 6 potions to Frog_Bro_. (P-008, P-009, P-010)
8. On 2026-11-01 at 21:33 UTC, Unalign queried the playtime of Frog_Bro_ and HavenCham. As of 2026-11-01 21:33 UTC, both Frog_Bro_ and HavenCham had more than 6 days of total playtime; even if they were in game 24/7, they both must have had at least 6 hours of playtime since the contract started, constituting Capacity under the Contracts Act. (P-011)
III. CLAIMS FOR RELIEF
1. HavenCham and Frog_Bro_ formed a valid contract under the Contracts Act, yet Frog_Bro_ did not deliver:
- 52 netherite ingots.
- 1 Elytra with unbreaking 3 and mending.
- 1 Copper drill.
- 8 duration 1 fireworks.
- 3 steaks.
2. Frog_Bro_ misled and/or deceived HavenCham by not receiving the most important items promised under a valid contract. This is Misleading Conduct in Trade or Commerce under Part VI of the RCCA for "(a) engag[ing] in conduct that is misleading, deceptive, or likely to mislead or deceive another person in connection with the promotion, sale, or supply of goods or services."
3. Frog_Bro_ failed to deliver the most important items under a valid contract. This is Failure to Deliver Goods or Services under Part VI of the RCCA for "(a) fail[ing] without lawful excuse to deliver goods or services that they have agreed to supply under a valid transaction or contract."
IV. PRAYER FOR RELIEF
The Plaintiff seeks the following from the Defendant:
1. For Breach of Contract or Failure to Deliver Goods or Services, either:
a. Specific Performance of delivering:
- 52 netherite ingots.
- 1 Elytra with unbreaking 3 and mending.
- 1 Copper drill.
- 8 duration 1 fireworks.
- 3 steaks.
2. In the alternative that 1 can't be awarded, $15,000 minus the market value of the delivered items for Unjust Enrichment as Compensatory Damages, for obtaining a benefit at the Plaintiff's expense.
3. 250 Civil Penalty Units for Misleading Conduct in Trade or Commerce as Punitive Damages.
4. In the alternative that claim 3 can't be awarded, 200 Civil Penalty Units for Failure to Deliver Goods or Services as Punitive Damages.
5. Any other remedy the court considers just and proper.
6. 30% of the case value or $3,000 to unalign as Legal Fees.
By making this submission, I agree I understand the penalties of lying in court and the fact that I am subject to perjury should I knowingly make a false statement in court.
