Executive Order 62/26 - Government Salaries and Department Categories
By the authority vested in me by the Redmont Constitution
I, Theory Fontaine, President of the Commonwealth of Redmont, do declare the following under this Executive Order:

Whereas, a "President may issue and revoke Executive Orders to ensure good governance of the server" (Const. 24(5));
Whereas, Secretaries are tasked with "[c]reating and amending departmental policy in accordance with the President's direction" (Const. 29(1)(b));
Whereas, section 8(3) of the Redmont Economic Standards Act provides that "non-cabinet Executive positions and any other position not assigned by Congress In this act are assigned by Presidential Executive Order to levels 0 and 4 through 8";
Whereas, section 8(4) of that Act permits an assignment to be raised or lowered outside the responsibility descriptor having regard to required in game activity, relative workload, leadership and institutional responsibilities, necessary skills, demand, receipt of commission, and the level of public scrutiny;
Whereas, section 11(1) of that Act requires the President to assign each Department a category of A, B or C by Executive Order;
Whereas, section 5 of that Act requires that public remuneration be apolitical, comparative, performance based and accountable;
Whereas, the assignments continued in force by section 21(1) of that Act were made under the repealed Economic Standards Act, and no longer reflect either the work performed or the commissions now paid for it;
Section 1. Purpose and Intent
(1) The purposes of this Order are:
(a) to assign every non-cabinet Executive position to a salary level under section 8 of the Act;
(b) to move positions whose work is already paid for by outcome onto the commission level, so that the Commonwealth pays those positions for results rather than for presence;
(c) to assign each Department a category under section 11 of the Act; and
(d) to repeal Executive Order 22/26.
(2) The President finds as follows:
(a) A salary under the Act is paid per 15 minutes of active playtime. It is a payment for being present and available. Work actually completed is paid for by commission, by departmental policy, and by bonus.
(b) Where a Department already pays a position for each case, each event or each task it completes, a full salary on top of that pays twice for the same hour.
(c) Several positions carried forward from Executive Order 22/26 sit out of step with comparable work elsewhere in the public service, contrary to section 5(2) of the Act. Trainee ranks are paid at two different levels depending on which Department happens to be training them, and one Department carries three positions at level 4.
(d) Executive Order 22/26 assigned all nine Departments to Category A. A system of three categories in which every Department sits in the first is not a system of categories, and it commits the Commonwealth to the highest rate of departmental loading in every case without ever asking whether it is earned.
Section 2. Framework of Assignment
(1) The levels available to the President under section 8(3) of the Act are applied on the following basis:
(a) Level 0 is for positions whose output is paid for under a written departmental policy, and whose value to the Commonwealth is measured by what they complete rather than by the time they spend online.
(b) Level 4 is for the head of a division of a Department, who answers to the Secretary for that division.
(c) Level 5 is for senior positions carrying specialised duties, gatekeeping responsibility, or the supervision of others.
(d) Level 6 is for standard positions performing the ordinary work of the Department.
(e) Level 7 is for entry positions performing routine work, and for positions whose principal remuneration is received by commission under a departmental policy.
(f) Level 8 is for trainee positions, the holder of which is primarily learning the role.
(2) This framework informs the assignments made in section 3. Where an assignment departs from it, the departure is made under section 8(4) of the Act.
Section 3. Salary Levels
(1) The following positions are assigned to the following salary brackets:

(2) The salary figures in this section are reproduced from the table in section 8(1) of the Act and are informative only. Where they differ from that table, the Act prevails.
(3) A position appearing in this section is assigned to the bracket in which it appears, and to no other.
Section 4. Commission Positions
(1) A position assigned to level 0 receives no salary under section 7 of the Act. It is paid by commission, bonus, or another payment authorised by the Act or by the written policy of its Department, and its holder continues to receive the ordinary wage available to every citizen.
(2) The President finds that the work of a Detective is investigative, case driven, and measured by what the investigation produces. It is work of a kind the Department of Homeland Security is best placed to price case by case, in the same way the Department of Justice prices the work of a Special Prosecutor.
(3) The Secretary of Homeland Security shall publish a written compensation policy, made under section 10(1) of the Act, setting the amounts payable to a Detective for each investigation, charge, or other outcome.
(4) The assignment of Detective to level 0 takes effect upon the publication of that policy. Until it is published, Detective remains assigned to level 7.
(5) A person holding a position assigned to level 0 together with another public position is paid under section 7(2) of the Act at the level of that other position, and retains the commission attaching to the level 0 position.
(6) A Department may not use a level 0 assignment to obtain work for nothing. A Secretary who has not published a schedule for a level 0 position within their Department shall not assign work to it.
Section 5. Department Categories
(1) The following Departments are assigned Category A for the purposes of section 10 of the Act:
(a) Department of Construction and Transportation
(b) Department of Commerce
(c) Department of Justice
(d) Department of Homeland Security
(2) The following Departments are assigned Category B:
(a) Department of Public Affairs
(b) Department of State
(c) Department of Education
(3) The following Departments are assigned Category C:
(a) Department of Health
(b) Department of the Interior
(4) These assignments are made having regard to the factors in section 11(2) of the Act. The President finds that:
(a) the Departments in Category A require sustained in game activity, carry the largest standing workloads, and attract the highest public scrutiny;
(b) the Departments in Category B carry substantial workloads that are cyclical, arising with elections, events, terms of study and the calendar rather than continuously; and
(c) the Departments in Category C carry narrower remits and smaller staff complements, which is a finding about the size of a Department and not about the quality of its work.
(5) In accordance with section 11(3) of the Act, a change of category made by this Order takes effect from the first day of the month following its publication.
(6) A Secretary may request a review of their Department's category by written submission to the President addressing the factors in section 11(2). The President shall review every category at least once each term.
Section 6. Unlisted, Renamed and Abolished Positions
(1) A non-cabinet Executive position that is not listed in section 3 and is not assigned a level by Congress is assigned to level 0 until the President assigns it a level by Executive Order.
(2) A Secretary who creates or identifies such a position shall request an assignment from the President, stating the duties of the position and the level sought.
(3) Where a position listed in section 3 is renamed and its duties are substantially unchanged, its assignment attaches to the position under its new name.
(4) Where a position listed in section 3 is abolished, its assignment lapses.
Section 7. Salary Guide
(1) The Department of Education shall update the guide titled 'Government Pay' maintained under section 9 of the Act to reflect this Order.
(2) The guide is informative. Where it conflicts with this Order or with the Act, this Order or the Act prevails.
Section 8. No Retrospective Effect
(1) This Order does not affect a salary, commission or bonus that accrued before the relevant provision of this Order took effect.
(2) Nothing in this Order authorises the recovery of an amount properly paid under Executive Order 22/26.
Section 9. Fiscal Neutrality
(1) This Order creates no appropriation and authorises no payment that is not already authorised by the Act or by an appropriation.
(2) A payment affected by this Order is made from the budget of the Department or branch concerned, and may not be made where that budget is exhausted.
(3) The assignments in this Order are intended to reduce the standing payroll cost of the Executive overall. Where a Department's cost rises under section 3, that increase is to be met from that Department's existing budget.
Section 10. Interpretation
(1) A reference in this Order to 'the Act' is a reference to the Redmont Economic Standards Act.
(2) Where this Order conflicts with the Act, the Act prevails.
(3) To the extent that the language of any Executive Order issued before this one conflicts with this Order, that language is superseded by this Order.
(4) If a provision of this Order is held invalid or unenforceable, the remainder continues in full force and effect.
Section 11. Repeals
(1) Executive Order 22/26 - Government Salaries is hereby repealed.
Section 12. Implementation
(1) Sections 1, 2, 4, 6, 7, 8, 9, 10 and 11 take effect immediately upon signing.
(2) Section 3 takes effect as quickly as is practicable for Staff to implement the in game salaries it specifies, save that the assignment of Detective takes effect in accordance with section 4(4).
(3) Section 5 takes effect in accordance with section 11(3) of the Act.
(4) The Secretary of Commerce shall notify Staff of the changes required by this Order and shall confirm to the President when they are in effect.
