Executive Order 57/26 - Commencement of the Town of Willow

By the authority vested in me by the Redmont Constitution
I, Theory Fontaine, President of the Commonwealth of Redmont, do declare the following under this Executive Order:

Whereas, a "President may issue and revoke Executive Orders to ensure good governance of the server" (Const. 24(5)).
Whereas, Section 29(1)(b) of the Constitution provides that Secretaries are responsible for "creating and amending departmental policy in accordance with the President's direction."
Whereas, the Willow Township Act has achieved a supermajority in both chambers of Congress, has received Presidential assent, and has been approved at referendum in accordance with Section 36 of the Constitution.
Whereas, the Town of Willow is accordingly established, and Section 32(1) of the Constitution now recognises it alongside the Towns of Aventura and Oakridge.
Whereas, Section 32(2) of the Constitution requires that each Town have a Constitution establishing its basic representative and democratic system of local government.
Whereas, Section 6(2) of the Willow Township Act requires the Department of State to facilitate the first election of the Willow legislature within seven days of commencement.
Whereas, the Willow Interim Administrative Board established under Executive Order 53/26 dissolves upon the first Mayor of the Town taking office, and an orderly transfer of administration is required.
Whereas, the Town of Willow cannot hold funds until a government account is established for it by Server Leadership, and provision must be made for revenue accruing to the Town in the interim.
Whereas, the arrangements governing local government generally do not yet contemplate the Town of Willow, and must be brought into line.

Section 1. Purpose
The purpose of this Executive Order is to give effect to the establishment of the Town of Willow, to provide for its first election and its Constitution, to transfer administration from the Executive to the Town, and to bring the general arrangements for local government into line with the existence of a third Town.
Section 2. Definitions
1. The Act means the Willow Township Act.
2. Commencement means the date on which the Act took effect, being the date on which the referendum required by Section 36(3) of the Constitution was approved.
3. Charter means the Willow Constitutional Charter submitted under Section 11 of Executive Order 53/26.
4. Board means the Willow Interim Administrative Board established under Section 4 of Executive Order 53/26.
5. Commission means the Willow Commission established by the Charter.
Section 3. Commencement
1. Commencement occurred upon the approval of the referendum held under Section 36(3) of the Constitution.
2. Where Section 1(2) of the Act provides for enactment upon signage, that provision is to be read subject to Section 36(3) of the Constitution, which governs. All periods running from commencement under the Act run from the date in Section 3(1).
3. The Town of Willow is a Town of the Commonwealth for all purposes from that date.
Section 4. The Willow Constitution
1. The Charter is recognised as the Constitution of the Town of Willow for the purposes of Section 32(2) of the Constitution, on an interim basis and from commencement.
2. The first Commission shall, at its first sitting, ratify the Charter or adopt an amended Charter in accordance with its own terms. Until it does so, the Charter as recognised under Section 4(1) has full effect.
3. Recognition under this Section does not validate any provision of the Charter that is inconsistent with the Constitution, federal law, or the Staff Veto governing the agricultural area.
Section 5. First Commission Election
1. The Department of State is directed to facilitate the first election of the Willow Commission in accordance with Section 6(2) of the Act.
2. Declarations shall open no later than three (3) days from the date of this Order, so that the election concludes within the period required by the Act.
3. The election shall be conducted for five (5) seats by Single Transferable Vote, with a nomination period of forty-eight (48) hours followed by voting open for forty-eight (48) hours.
4. Candidacy and voting requirements are those set out in the Charter and in Section 12 of Executive Order 53/26.
Section 6. Transitional Term
1. The Charter provides for Commission elections in February, April, June, August, October and December, on the fifteenth day of each assigned month.
2. Because the first election cannot be held on that date, the term of the first Commission shall expire on 15 October 2026, and the ordinary electoral cycle shall run from that date.
3. The first Commission shall elect a Mayor and Deputy Mayor from among its members within ninety-six (96) hours of taking office.
Section 7. Transfer of Administration
1. The Board continues to administer the Town until the first Mayor takes office, whereupon it dissolves under Section 4(6) of Executive Order 53/26 and its functions pass to the Town.
2. The Board shall deliver to the first Mayor, within seven (7) days of that Mayor taking office:
a. the farm plot register maintained under Section 5(2) of Executive Order 53/26, together with the recorded baseline;
b. any building and aesthetic standard published under Section 9 of that Order;
c. the records of the Willow Community Assembly; and
d. any outstanding matter before the Board.

3. The Department of Construction and Transportation shall transfer ownership of the Town region to the Mayor and shall mark the Town boundary.
Section 8. Farm Plots and Revenue
1. The Department of the Interior retains administration of farm and ranch plots in accordance with Section 32(5) of the Constitution.
2. Rent collected on farm plots within the Town accrues to the Town from commencement, in accordance with Section 7(2) of Executive Order 53/26.
3. A government account for the Town of Willow must be established by Server Leadership before the Town can hold funds. Until that account exists, rent on farm plots within the Town continues to be collected by the Department of the Interior and held by the Commonwealth on the Town's behalf.
4. Upon the establishment of the Town's government account, the Department of the Interior shall transfer to it the full amount of farm plot rent collected within the Town since commencement, together with the balance of the designated Willow account maintained under Section 7(1) of Executive Order 53/26.
5. The Department of the Interior shall maintain a public record of rent collected under Section 8(3) so that the amount owing to the Town is ascertainable at any time.
6. The Town shall maintain and publish the farm plot register no less than monthly. Where the number of farm plots available for lease falls below the baseline, Section 32(5)(d) of the Constitution applies automatically.
Section 9. General Local Government Arrangements
1. Residency. The Town of Willow is a valid residency. Any player holding residency in the Willow District immediately before commencement is taken to hold residency in the Town of Willow, and that conversion does not count as a change of residency for the purposes of any waiting period.
2. Industry and Theme. The Town of Willow is allocated the industry and theme of Agriculture.
3. Town Requirements. The Town of Willow shall have 30 days from commencement to meet the standing requirements applying to Towns. The Department of State may extend that period on application by the Mayor.
4. Grants. The Town of Willow is eligible for Town grants from commencement on the same terms as any other Town.
5. Forums. A forum node for the Town of Willow shall be established under the Cities and Towns node, with administrative permissions granted to the Mayor. The Charter and all bylaws are to be maintained under that node.
Section 10. Town Marshal
1. The Department of Homeland Security is directed to work with the Town of Willow to enable a resident of the Town to attain the rank required by the Charter to hold the office of Town Marshal.
Section 11. Reservation of Staff Authority
1. Nothing in this Order limits the reserve power of Server Leadership under Section 38 of the Constitution.
2. Where any provision of this Order is silent or ambiguous, it is to be read consistently with the Staff Veto governing the agricultural area.
Section 12. Implementation
1. This Executive Order shall take effect immediately upon its signing.
2. To the extent of any inconsistency with a previous Executive Order in its application to the Town of Willow, this Order prevails.
3. Executive Order 53/26 remains in force to the extent it is not inconsistent with this Order, and expires upon the dissolution of the Board.
