Standardise the Eminent Domain Process​

BE IT ENACTED by the Mayor and Council of Aventura:

1 - Short Title and Enactment
(1) This Act may be cited as the 'Recalls Act .'
(2) This Act shall be enacted immediately upon its passage.
(3) This Act has been sponsored by Julia Tempest.

2 - Reasons
(1) The current eminent domain process is under an old and aged act known as the Eminent Domain Act.
(2) The act in question has certain issues that.
(3) This bill will serve as a replacement to that act.

3 - Repeals
(1) The Eminent Domain Act is hereby repealed.

4 - Eminent Domain Process
(1) The Head of Development shall be vested with the sole power to begin the eminent process.
(2) The Head of Development shall offer a fair and reasonable compensation to the plot owner as agreed upon by both parties.
(3) All plot owners shall have the right of negotiation and refusal.

5 - Eminent Domain Court Process
(1) If a plot owner refuses eminent domain, the Town of Aventura may pursue eminent domain with the courts at the discretion of the Head of Development.
(2) The Town of Aventura shall file the request for eminent domain with the relevant court.
(3) The Town of Aventura must be willing to offer a fair and reasonable compensation in court.

6 - Severability Clause
(1) If one part of this law is found to be unenforceable or unconstitutional, only the offending part shall be struck, and the remaining parts shall remain in effect.
