Basis for Appeal: The Presiding Officer over the case failed to award any legal fees to the Defendant. As stated in the Redmont Civil Code Act Part 3 §7(2), the prevailing party is to be awarded either 30% of the case value or $3,000, whichever greater. Therefore, the Defense humbly requests the Plaintiff be ordered to award the Defense the $3,000 in legal fees under the aforementioned sections of the RCCA.

APPEAL DENIED.


The DCR action was dismissed WITHOUT prejudice, thus this action could be re-introduced by Plaintiff. In order for this court to affirm that Appellant "prevailed", this Court would have to accept that a permanent "case value" was assigned to this matter. A dismissal without prejudice does not constitute a final judgment on the merits, and no award was ever granted or denied to either party. The Redmont Civil Code Act Part III Section 7 contemplates legal fees flowing from a resolved case with an ascertainable value, not from a procedural dismissal that leaves the underlying dispute entirely unresolved. As no case value exists and no party has truly prevailed, there is no basis upon which to award legal fees at this time. The Appellant retains no entitlement to legal fees unless and until this matter is fully adjudicated on its merits and a judgment is entered in the Defendant's favor.
