Basis for Appeal: The verdict in [2025] FCR 21 found RaiTheGuy not guilty of three crimes, overruling a summary criminal judgment. This is very wrong and inappropriate for many reasons.
1. The trial in question was a civil trial and not a criminal trial. Criminal and civil trials have different standards of proof. Criminal verdicts can and should not be given based on a civil trial.
2. The verdict overrules a judgment without being an appellate case of the judgment in question. This goes against all reasonable expectations, as well as against the principle of Res Judicata. Allowing judges to overrule judgements previously made, in cases that are not appellate to those judgements completely destroys the value of verdicts, judgements and our judicial system as a whole.
