What Case are you Appealing?: [2024] FCR 99

Basis for Appeal: I was charged with perjury for a false statement I made. I admitted that the statement was false but in order for it to be perjury it must knowingly be false. I was willing to fall a witness at the time to confirm my side of the story because the statement I made I believed to be the truth therefore it cant be perjury as it wasnt knowingly false
Duke also argued that because the commonwealth knew that it was false it was still perjury as Im representing the commonwealth. People working for the commonwealth may have known the actual truth but Im being charged individually with perjury therefore the decision should only be based on my knowledge and what I believed to be true only.
