Case Filing

IN THE SUPREME COURT OF THE COMMONWEALTH OF REDMONT
CIVIL ACTION

12700k
Plaintiff

v.

The Commonwealth of Redmont
Defendant

COMPLAINT
The Plaintiff complains against the Defendant as follows:

The Defendant unlawfully removed Senator 1950Minecrafter from the Senate without meeting the constitutional requirements for removal. As a result of this illegal removal, a special election was held and Multiman155 was elected to fill a seat that should never have been vacant. The Plaintiff seeks to have this unconstitutional removal reversed, Multiman155 removed from office, and 1950Minecrafter reappointed to the Senate.

I. PARTIES
1. 12700k
2. The Commonwealth of Redmont

II. FACTS
1. On October 28, 2025, Senator Sofia2750 proposed a Motion to Remove Senator 1950Minecrafter from the Senate (see P-001).
2. The Motion to Remove alleged that Senator 1950Minecrafter had not logged in for 1 month and 9 days, had 0 hours of playtime in the required period, and had failed to interact with constituents.
3. The motion was voted on by the Senate, with only three Senators casting votes: Senator Bezzergeezer (AYE), Senator Inknet (AYE), and Senator Anthony_org (AYE).
4. The motion was declared "PASSED" with a vote count of "3 aye 0 nay 0 abstain".
5. At the time of the vote, the Senate consisted of six members. Excluding Senator 1950Minecrafter (the individual in question), there were five remaining Senators eligible to vote on the removal.
6. The Constitution, Section 11(2) states: "Senator Removal. A Senator can be removed from Congress early by the relevant presiding officer with the consent of all members of their chamber (excluding the individual in question)."
7. The Legislative Standards Act, Section 12(7)(c) states: "A Motion of Removal must be made and voted on in accordance with the constitutional processes for removal of a member of congress, and the passing requirements shall be those that are defined in the Constitution."
8. Following the removal of Senator 1950Minecrafter, a special election was held to fill the vacant Senate seat. (see P-002)
9. Multiman155 was elected in the special election and currently serves as a Senator.

III. CLAIMS FOR RELIEF
1. Unconstitutional Removal of Senator 1950Minecrafter
Section 11(2) of the Constitution establishes the exclusive procedure for removing a Senator from Congress early, requiring "the consent of all members of their chamber (excluding the individual in question)." At the time of the Motion to Remove Senator 1950Minecrafter, the Senate consisted of six members. Excluding Senator 1950Minecrafter himself, there were five Senators eligible to vote on the removal.

The plain language of the Constitution requires "consent of all members" of the chamber, which necessarily means all five eligible Senators must have consented to the removal. As evidenced by Exhibit P-001, only three Senators voted on the Motion to Remove: Senator Bezzergeezer, Senator Inknet, and Senator Anthony_org. The constitutional threshold was not met, as only three of the required five Senators consented to the removal.

The removal of Senator 1950Minecrafter was therefore unconstitutional and void ab initio. The failure to obtain the consent of all members renders the entire removal proceeding invalid under the Constitution.

2. Illegitimate Senate Seat
Because Senator 1950Minecrafter was unconstitutionally removed, his Senate seat never legally became vacant. A void action cannot create legal consequences, and therefore no vacancy existed that could be filled through a special election.

The special election held to fill the allegedly vacant seat was conducted without legal basis, as it was predicated on an unconstitutional removal. Multiman155's election to the Senate and current service as a Senator is therefore illegitimate, as he was elected to fill a seat that was never legally vacant. Multiman155 holds his Senate seat solely by virtue of an unconstitutional removal that violated the express requirements of Section 11(2) of the Constitution.

3. Violation of Constitutional Processes
Section 12(7)(c) of the Legislative Standards Act requires that "A Motion of Removal must be made and voted on in accordance with the constitutional processes for removal of a member of Congress, and the passing requirements shall be those that are defined in the Constitution." The Legislative Standards Act explicitly incorporates and mandates compliance with constitutional removal procedures.

The removal of Senator 1950Minecrafter failed to comply with the constitutional requirement in Section 11(2), as it did not obtain the consent of all members of the Senate. This violation of constitutional processes undermines the separation of powers, the integrity of the legislative branch, and the constitutional framework that governs the Commonwealth of Redmont. When constitutional procedures for removal are disregarded, it sets a dangerous precedent that threatens the stability and legitimacy of democratic institutions

IV. PRAYER FOR RELIEF
The Plaintiff respectfully requests that this Court:

1. Declare that the removal of Senator 1950Minecrafter on October 28 2025 was unconstitutional and void;
2. Order the immediate removal of Multiman155 from the office of Senator, as his election was predicated on an unconstitutional vacancy;
3. Order the reappointment of 1950Minecrafter to the Senate, effective immediately;
4. Declare that all Senate actions taken during the period when Multiman155 illegitimately held office remain valid, to preserve legislative continuity and protect reliance interests;
5. Grant the Plaintiff $6,000 in legal fees.

Motion

IN THE SUPREME COURT OF THE COMMONWEALTH OF REDMONT
MOTION FOR EMERGENCY INJUNCTION

The Plaintiff respectfully requests that this Court issue an emergency injunction to prevent Senator Multiman155 from exercising any congressional powers, including voting on bills, motions, and nominations, pending resolution of this case. Senator Multiman155 currently holds his Senate seat solely by virtue of an unconstitutional removal of Senator 1950Minecrafter that violated Section 11(2) of the Constitution. Allowing an illegitimately seated Senator to continue participating in the legislative process causes immediate and irreparable harm to the Commonwealth, as his votes may affect the passage or failure of legislation, confirmations, and other matters of public importance.

Should this Court ultimately determine that Senator Multiman155's seat is illegitimate, the harm caused by his participation in legislative actions cannot be undone. Bills passed or failed by a single vote, nominations confirmed or rejected, and other congressional actions taken with his participation would be tainted by constitutional invalidity. This harm is irreparable because legislative actions, once taken, cannot be easily reversed, and the damage to the rule of law and public confidence in democratic institutions caused by allowing an unconstitutionally seated Senator to exercise legislative power cannot be remedied by monetary damages.

The Plaintiff, therefore, respectfully requests that this Court immediately enjoin Senator Multiman155 from voting on or participating in any legislative matters until this Court can fully adjudicate the constitutional violations alleged in this Complaint.
