We request the following evictions/auctions be paused for the duration of this case:


These plots rightfully belong to the Plaintiff, and this claim is currently in litigation. It is illegal to auction them off on behalf of the non-owner, MattTheSavvy.

COMPLAINT
The Plaintiff complains against the Defendant as follows:

The plots being auctioned are not rightfully owned by the person they are auctioning them in order to pay the debts of. They belong to 12700k.

II. FACTS
1. On August 25, 2025, the Hon. ko531 issued an Emergency Injunction requiring that C745 and S104 not be evicted for the duration of the case. This is because the ownership of those plots is disputed and evicting/auctioning them would cause harm [Exhibit P-001].
2. On October 17, 2025, the Hon. AmityBlamity ignored this order, its purpose, and the rights of 12700k and chose to order the DCT to evict and auction these plots anyway [Exhibit P-002].

III. CLAIMS FOR RELIEF
1. The plots are protected by a pre-existing Emergency Injunction from a separate case. They cannot be auctioned.

IV. PRAYER FOR RELIEF
The Plaintiff seeks the following from the Defendant:
1. The court order to evict and sell these plots be overturned.
2. $1 in Legal Fees.

I will be accepting the emergency injunction and order the DCT to pause all eviction auction proceedings on these plots to be paused for the duration of this case, I am currently out of house so summons will be issued later.

Failure to appear within 72 hours of this summons will result in a default judgement based on the known facts of the case.

Both parties should make themselves aware of the Court Rules and Procedures, including the option of an in-game trial should both parties request one.

IN THE FEDERAL COURT OF THE COMMONWEALTH OF REDMONT
MOTION TO DISMISS - FAILURE TO INCLUDE PARTY (Rule 5.7)

The Commonwealth moves that the complaint in this case be dismissed, and in support thereof, respectfully alleges:

1. Failure to Include Necessary Parties
The Plaintiff has filed the present action seeking to overturn a prior Court Order issued in Pepecuu v. MattTheSavvy [2025] FCR 100, a case to which the Plaintiff was not a party. The prior case involved the parties Pepecuu and MattTheSavvy, who were the direct and affected participants in that proceeding. Despite this, the Plaintiff has failed to name or include either Pepecuu or MattTheSavvy as parties to the present case.

Rule 5.7 of the Court Rules and Procedures explicitly provides that a Motion to Dismiss may be filed for a Plaintiff's failure to join all appropriate parties to a case. As such, dismissal is warranted here.

2. Violation of Due Process
Allowing this case to proceed without the inclusion of Pepecuu and MattTheSavvy would constitute a clear violation of their right to due process. The Plaintiff seeks relief that would directly overturn a prior judgment affecting their legal rights and interests. Fundamental principles of fairness and (natural) justice require that no person be deprived of rights or subject to adverse judicial outcomes without notice and an opportunity to be heard.

Without the participation of these indispensable parties, this Court cannot ensure that all affected individuals are properly represented or that any resulting decision would be legally sound. Proceeding without them would compromise the ability of the Court to render a fully informed and equitable judgment.

WHEREFORE, for the foregoing reasons, the Commonwealth respectfully requests that this Honourable Court grant its Motion to Dismiss, dismiss the Plaintiff's Complaint in its entirety without prejudice, and grant such other and further relief as the Court deems just and proper.
