Basis for Appeal: The Legal Damages Act States that

" In the event that the plaintiff initiates legal proceedings and such proceedings are dismissed by the court or result in a judgment in favor of the defendant, the prevailing party's legal representatives shall be entitled to recover reasonable legal fees from the plaintiff"

The Defence does not believe that $0 is a reasonable legal fee for the work that had to be put in to find a reason to get the case dismissed and also for the construction of the motion to dismiss.

The Federal Court has decided to accept this appeal.
