Plaintiffs

v.

Elv_K
Defendant

COMPLAINT
The Plaintiff complains against the Defendant as follows:

WRITTEN STATEMENT FROM THE PLAINTIFF

We paid Elv K 16k upfront, and it's literally been four weeks of endless arguing and terrible communication. Today he tried to close the ticket and claim the job was done, but when I went to check, they only finished 7 out of the 16 floors and left their junk everywhere for me to clean up I managed to squeeze the 2k delay compensation out of him, but now the guy is acting like we need to open a brand new ticket to get them to finish the rest.

I. PARTIES
1. BnyBny_ as the plaintiff
2. TaechiMTEA as the co-plaintiff
3. Elv_K as the defendant

II. FACTS
1. The plaintiff paid sixteen thousand(16k) dollars to the defendant in exchange for building on their skyscraper(P-001, P-002, P-003).
2. The plaintiff gave the defendant one(1) week to finish building(P-003).
3. After that deadhline the construction was not done(P-004, P-005).
4. The plaintiff did not get their payment fully back, the only return was two thousand(2k) in a form of a delay compensation.
5. Five weeks later the construction is not done and the defendant is not responding.

III. CLAIMS FOR RELIEF
1. Breach of contract.
The defendant entered a lawfully binding contract under the contracts act Act of Congress - Contracts Act by saying "deal"(P-001).
After that they have proceeded to not finish their obligation therefore breaching the contract.
2. Failure to deliver goods or services.
The defendant has failed to deliver a service that they have agreed to supply under a valid transaction or contract.

IV. PRAYER FOR RELIEF
The Plaintiff seeks the following from the Defendant:
1. Sixteen thousand(16k) dollars in liquidated damages in order to return the payment.
2. Ten thousand(10k) dollars in consequential damages for failure to deliver goods or services.
3. Additional legal fees that the court finds just.

By making this submission, I agree I understand the penalties of lying in court and the fact that I am subject to perjury should I knowingly make a false statement in court.

Your Honor,
We are discussing settlement, but our clients have not responded. Can we have an extension? We wouldn't want to accept an offer without approval from our clients first.

Thank you.

You are appearing on behalf of Defendant? If so, show evidence of representation and then I'll issue a stay on proceedings.

Defendant failed to appear. I'll give @amah853 24 hours to provide evidence of representation or we'll continue in default judgment.
Apologies your honor, I've been unable to contact my client.

It is for this reason I was unable to obtain a statement more explicit then the one attached below.

Alright. I'll grant a stay on proceedings. Please do report back in 72 hours on how settlement negotiations are going.

For now I do not see any way in which my client may get a fair settlement, the plaintiff would like to ask the court and the defendant to continue the case as usual to not further slow down the process.
Upon request from Plaintiff, we will continue on. The stay imposed is hereby lifted.

Defense has 48 hours from now to post an answer @amah853.

It appears the Defense will not agree to a settlement. We will persue this case.

KeystoneLaw has assigned @KeyChnky321 to this case, and I am switching counsel to him, effective immediately, to represent Elv_K.
