COMPLAINT
The Plaintiff complains against the Defendant as follows:

WRITTEN STATEMENT FROM THE PLAINTIFF

On 10th July 2025, the President appointed juniperfig as Acting Secretary to the Department of Public Affairs due to xDarkkex going on LoA. The Plaintiff believes that the President removed xDarkkex from the position of Secretary of Public Affiars due to this action.

II. FACTS
1. On the 10th of July 2025, the President appointed juniperfig to the position of Acting Secretary of Public Affairs since xDarkkex was going on leave (Exhibit A).
2. This action removed xDarkkex from the position of Secretary of Public Affairs, meaning that when he was supposed to return from LoA, he needed to be confirmed by the Senate again.

III. CLAIMS FOR RELIEF
1. When justifying the decision to appoint juniperfig as Acting Secretary, the President cited clause 3 of this section from the Executive Standards Act (link):
(1) An Acting Secretary may serve in that role without Senate confirmation for a period of up to 14 days, starting from when they assume the office of Acting Secretary. After that time period elapses, the Acting Secretary must receive Senate confirmation if they are to continue in that role. After an Acting Secretary's term is up, they may not be Acting Secretary for 14 days.
(2) During a vacancy in the Secretary position, their duties fall to the Deputy Secretary until a new Secretary can be chosen.
(3) Should both the Secretary and Deputy Secretary be vacant, the Secretary’s duties shall temporarily fall to a person appointed by the President.

2. The clause cited by the President applies to when there is no Secretary (i.e the position is vacant), not when the Secretary is on LoA. Therefore, when juniperfig was appointed as Acting Secretary, it means that xDarkkex was removed by the President from the position of Secretary of Public Affairs. Following xDarkkex's return from LoA on the 13th of July 2025, he was appointed back to the position of Secretary of Public Affairs without any senate confirmation, and so his appointment was illegitimate.

3. When a Secretary goes on LoA, the powers are delegated to the Deputy Secretary (or any other individual they choose), rather than the seat itself being delegated. Some examples with other positions are: when a Representative goes on LoA, their seat is not vacant, when a Judge goes on LoA, their seat is not vacant, and when the President goes on LoA, their seat is not vacant. This applies to basically every single position in the Commonwealth, including Secretaries.

IV. PRAYER FOR RELIEF
The Plaintiff seeks the following from the Defendant:
1. Removal of xDarkkex from Secretary of Public Affairs.
2. Reversal of all firings, hirings and policy changes since 13th July 2025.
3. $5,000 in legal fees.
4. $25,000 in punitive damages.
