CONGRESS OF THE
COMMONWEALTH OF REDMONT



A BILL TO​

To provide a comprehensive framework for Diplomacy







The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

PART I — PRELIMINARIES


(1) Short Title and Enactment

(A) This Act may be cited as the "Wilds and Alexandria Act" or the “WA Act.”​
(B) This Act shall be enacted immediately upon its signing.​
(C) This Act has been authored by Gwi Styx and Gluonmaster.​
(D) This Act has been sponsored by Gluonmaster.​
(E) This Act has been co-sponsored by MJL and Stanley.​


(2) Reasons and intent

(A) To fix issues with the International Community Framework or ICF for short.​

(i) Some Redmontians have read ICF and now seem to believe that Wild Communities can form legally binding treaties with Redmont. This violates staff intent since the Wilds is a volatile place and imposing rigid treaties upon it is absurd. This law seeks to clarify confusion;​
(ii) ICF prevents the DoS from recording a wild town’s player count or activity. These are relevant metrics which DoS has the right to consider;​
(iii) The ICF prevents all coordination with Wild Communities, including informal government coordination. Under this Act, Redmont’s government would be free to explore informal options for coordination so long as our government is aligned with staff intent.​


(B) To group all international legislation into one act.​
(i) As previously mentioned, this Act includes the ICF treaties and agreements framework but fixes the issues mentioned above.​
(ii) This Act includes the section from “the Diplomatic Act”, which established Diplomats, Embassies, and eliminated diplomatic immunity.​


(C) To establish some rights that protect Wild Towns, Redmont, and Alexandria from certain diplomacy that could harm these communities.​


(D) To allow a Presidential Administration to recognize Wild Communities and grant them Envoys as well as Embassies. This would be interesting for roleplay and grant Wild Communities the recognition they deserve.​


(E) To encourage discussion on future non-binding executive agreements between Redmont and Wild Communities. These would potentially help with wild landscape cleanup or hosting events so long as it follows staff intent.​

(F) To allow the Executive Branch discretion with how they choose to run diplomacy. For example, if the President thinks the DoS is overwhelmed, a President could prioritize a narrower list of tasks for the DoS regarding diplomacy. Additionally, a busy President could choose to delegate to the VP so they can propose treaties. This would make sense since the VP has a close relation with the Senate and therefore can run treaties by the Senate.​


(3) Repeal

(A) The “International Community Framework Act (ICFA)” shall be repealed.​


(B) The “Diplomacy Act” shall be repealed.​


(4) Definitions

(A) The Wilds refer to the area that neither Alexandria nor Redmont may govern. This area consists of the End, the Nether, the Wild, the Everwild, and the Outback.​


(B) A Wild Community consists of any group of players who live within the wilds and identify as part of a collective identity.​


(C) Recognized Nations is a category consisting of the Kingdom of Alexandria and the Commonwealth of Redmont.​


(D) Foreign Entities is a category consisting of Recognized Nations and Recognized Wild Communities.​


(E) For the avoidance of doubt, the Kingdom of Alexandria is both a Recognized Nation and a Foreign Entity. Where this Act grants rights or protections to Foreign Entities, those apply to Alexandria; where this Act reserves powers (such as Treaties) to Recognized Nations, that applies to Alexandria.​


(F) Formal treaties are documents which carry the force of law, are signed by one or more Recognized Nations, are proposed by the President of Redmont, and require approval of the Senate to go into effect.​


(G) Informal Agreements are documents which do not carry the force of law and may be terminated by either party at any time.​


(H) An Envoy is any person who has been appointed to represent a Foreign Entity.​


(I) An Embassy, when within Redmont, is a plot of land that is operated by a Foreign Entity while being subject to Redmont laws.​


PART II — DIPLOMATIC RIGHTS AND LIMITATIONS​


(1) No representative of a Foreign Entity shall enjoy immunity from Redmont Law by virtue of their diplomatic status.​


(2) Treaties or Agreements may not be construed to imply Redmont jurisdiction over any Foreign Entity.​


(3) Diplomatic actions between Redmont and any other Foreign Entity shall not result in any of the following:​
(A) One-sided extraction of resources, labor, or territory without proper compensation such as in the instance of a colony;​
(B) Fraudulent or intentionally deceptive Treaties or Informal Agreements;​
(C) Attempting to influence another Foreign Entity’s internal elections;​
(D) Giving up Redmont territory or attempting to acquire territory outside of Redmont;​
(E) Encouraging or participating in violence against any Foreign Entity;​
(F) Encouraging or participating in coercive acts against any citizen of a Foreign Entity without the consent of that Foreign Entity;​
(G) Attempting to interfere with or bring about a change in leadership of another Foreign Entity;​

(4) Each Foreign Entity reserves the right to remove or reject any individuals appointed to represent them as Diplomats, through a process defined within a Foreign Entity’s governing charter.​

PART III — REDMONT DIPLOMATIC STRUCTURE​


(1) Wild Community Recognition

(A) The President may recognize or revoke the recognition of a Wild Community by Executive Order. The President may delegate this power to members of the DoS or Vice President.​
(B) The President may create criteria to obtain recognition. The President may delegate this power to members of the DoS or Vice President. These criteria may include, but are not limited to:​
(i) Wild Community’s player activity;​
(ii) Wild Community’s hostility towards Redmont;​
(iii) Size of a Wild Community’s territory (represented by the claims of its members)​

(C) Should recognition of a Wild Community be revoked, their envoys, Embassy plots, and Informal Agreements will be revoked.​
(i) Note that Presidential or Legislative actions taken to abide by an Informal Agreement are not revoked, just the Agreement itself.​

(D) The Kingdom of Alexandria is always recognized.​


(2) Diplomats

(A) Any powers granted to the President with regard to appointing or removing diplomats may be delegated or reclaimed from the DoS or Vice President. Delegation will automatically expire once the President’s term ends.​

(B) The President may appoint a Redmont Ambassador to Alexandria or Redmont Envoys to any recognized Foreign Entity.​

(C) The President may appoint an Ambassador from Alexandria and Envoys from any recognized Foreign Entity.​

(D) To clarify, Wild Communities will not have Ambassadors to or from Redmont.​


(3) Diplomatic Relations

(A) The President of Redmont may establish or revoke diplomatic relations. The President may also direct the Department of State or Vice President to establish diplomatic relations.​
(B) Diplomatic relations include any of the following:​
(i) Establishing an Embassy for a Foreign Entity;​
(ii) Agreeing to an Informal Agreement with a Foreign Entity;​
(iii) Proposing a Formal Treaty between Redmont and Alexandria for ratification via the Senate;​
(iv) Proposing the Senate approve a withdrawal from a Formal Treaty;​


(C) Diplomatic Representatives of the Commonwealth shall exercise such functions as are assigned to them by the President, the Department of State, or by law.​


(4) Clarifications about Embassies

(A) Embassies serve as the official premises for the conduct of diplomatic relations.​
(B) The Embassies of Foreign Entities shall be administered by those entities.​
(C) Redmont may set aside plots, at the expense of Redmont, to be eventually used for the purpose of establishing Embassies in Redmont for Foreign Entities.​
(D) Plots set aside for Embassies are still subject to Redmont laws and regulations. Should an Embassy plot be found through Redmont’s judicial process to be in violation of Redmont law, it shall be repossessed by the Redmont Government.​


(5) Department of State
(A) The Department of State shall administer the foreign relations of the Commonwealth under the direction of the President.​
(B) The functions of the DoS regarding records include:​
(i) Maintaining official records of recognized Wild Communities, Diplomats, formal treaties, and informal agreements, these records shall be published publicly;​
(ii) Collecting information to assist the President’s Administration in monitoring whether Wild Communities follow the Administration’s recognition criteria.​

(C) The functions of the DoS regarding Embassies or Diplomats include:​
(i) Manage Embassies within Foreign Entities that were granted to Redmont;​
(ii) Manage plots set aside within Redmont that are meant for Embassy use but not yet run as Embassies;​
(iii) Monitor Diplomat and or Embassy compliance with Redmont law;​
(iv) Providing administrative support to Redmont Diplomatic Representatives;​
(v) Receiving and accrediting Diplomatic Representatives from Alexandria and recognized Wild Communities.​


(D) Other functions of the DoS include:​
(i) Advising the President on all diplomatic affairs;​
(ii) Managing diplomatic correspondence;​
(iii) Performing such other functions relating to foreign relations as may be assigned by the President or by law.​


(6) Alexandrian Ambassador to Redmont

(A) Is paid a salary and has an in-game role.​
(B) Is a Principal Officer.​
(C) Is appointed to represent Alexandria within the nation of Redmont.​
(D) May be removed by the President for reasons including but not limited to change in administration, dereliction of duty, inactivity, loss of approval by Alexandria, or corruption.​
(E) Must be approved by Alexandria.​


PART IV — TREATIES AND AGREEMENTS​


(1) Treaties for Recognized Nations

(A) Redmont’s Presidential Administrations may through the process defined within Part III section 3 propose treaties to other Recognized Nations, or propose withdrawals from treaties.​
(B) As stated within the Redmont Constitution, the Senate may vote on a proposed treaty or a proposed withdrawal. The Senate’s approval is required to ratify or annul a treaty.​
(C) A treaty will have the force of law, but shall be constrained by the same limits that constrain law. These limits are rules and judicial precedent.​
(D) Where a Treaty is not self-executing, Congress may enact legislation to implement it.​

(2) Agreements for Foreign Entities
(A) Redmont’s Presidential Administrations may through the process defined within Part III section 3 propose agreements to Foreign Entities.​
(B) An Agreement does not require Senate ratification, does not have the force of law, and may be nullified at any time by either side of the Agreement.​
(C) An Agreement may specify that Redmont’s President will issue an Executive Order to direct Redmont Departments to carry out actions outlined in the Agreement.​
(D) Where an Agreement is not self-executing, Congress may choose to enact legislation to implement it. Congress is under no obligation to enact or maintain legislation to uphold an Agreement.​

PART V - FINAL PROVISIONS​


(1) Diplomatic Continuity

(A) Any treaties previously agreed to by Redmont before the signing of this Act will not be void or subject to nullification.​

(2) Advice to the Presidency

(A) The President and Department of State are advised by Congress to look into agreements with Wild Communities that would help with landscape repair work in exchange for events, thereby providing Wild Communities with greater recognition, something which they may desire.​
(B) The President and Department of State are advised by Congress to recognize active Wild Communities, set aside plots for Embassies to these Wild Communities, and approve qualified Envoys presented by each recognized Wild Community.​
(3) Advice to the Presidency
(A) Should the “Wilderness Trade Protection Act” pass, congress is advised to amend it so that it makes sense under this framework or has its own definition of Wild Polities that's not derived from the ICFA.​


(4) Severability Clause

(A) If any provision of this Act is held invalid, the remainder of this Act shall continue in full force and effect.​
