COMPLAINT

The Plaintiff, Vithunder complains against the Defendant, joumasepoes69420 and states as follows:

I. INTRODUCTION

This case concerns a breach of contract and failure to perform agreed tutoring services after partial payment was provided by the Plaintiff to the Defendant

II. JURISDICTION

This court has jurisdiction over this matter as it involves a civil dispute concerning breach of contract and monetary damages which does not reach the threshold of higher courts.

III. STATEMENT OF FACTS

1. On 5/28/2026, the Plaintiff and defendant entered into an agreement for tutoring services.
2. The agreed payment structure was $100 total, consisting of $50 paid upfront and $50 to be paid upon the completion of services
3. The Plaintiff paid the Defendant $50 upfront in accordance to their agreement.
4. Following receipt of payment, the Defendant failed to provide any tutoring services as they had agreed upon.
5. The defendant then ceased communication and effectively abandoned the agreement.

IV. Causes of Action

1. Breach of Contract
According to the Redmont Civil Code Act (Part VI, Breach of Contract), a person commits a violation when they fail to perform obligations under a valid and enforceable contract without lawful excuse.

The Defendant failed to perform their obligation to provide the tutoring services after receiving payment, constituting a breach of contract.

2. Misleading Conduct in Trade or Commerce
Under the Redmont Civil Code Act (Part VI, Misleading Conduct in Trade or Commerce), a person commits a violation if they engage in condcut that is considered misleading or deceptive in connection with the supply of provided services.

The defendant did accept payment for the tutoring services and failed to provide said tutoring services, which constitutes misleading conduct.

3. Conversion
Under the Redmont Civil Code Act (Part VII, Conversion), a person commits a violation if they obtain property through deception or false pretences with intent to deprive the owner.

In this case, the Defendant obtained payment of $50 through an agreement, after providing that he was a retired person in the regarded field of tutoring and failed to provide the service, constituting obtaining the property by deception.

IV. Relief Sought
The plaintiff respectfully requests that this Court:
- Orders the repayment of $50 from the Defendant
- Award any and all additional damages deemed appropriate
- Grant any further relief the Court finds just and proper

VI. Conclusion

The defendant entered into a valid agreement, accepted payment, and failed to perform their obligation. Hence, the Plaintiff respectfully requests judgement in their favour.
