The Plaintiff complains against the Defendant as follows:
WRITTEN STATEMENT FROM THE PLAINTIFF
I. PARTIES
1. vaiiss (Plaintiff)
2. LarpTiktok (previously known as MyHeartMan) (Defendant)
II. FACTS
1. On 2026-07-03 at approximately 12:07:19 EST the Defendant posted an ad with the text "selling racing car for 2000 ,dealership cost is 8000. i m selling cheap msg me"
2. On 2026-07-03 at approximately 12:08:11 EST the Plaintiff told the Defendant "if i give u some iron blocks and diamond will u go lower iwth the price ?"
3. On 2026-07-03 at approximately 12:08:43 EST the Defendant told the Plaintiff "ofcourse i do 1000"
4. On 2026-07-03 at approximately 12:08 EST the Plaintiff told the Defendant to come to /zoo and the Defendant did so
5. The conversation from Fact 1 to 4 constitutes an Offer, Acceptance, Consideration, and Intent for the formation of a contract under the Contracts Act
6. On 2026-07-03 at approximately 12:10:36 EST the Plaintiff paid $1,000 to the Defendant
7. On 2026-07-03 at approximately 12:10:42 EST the Defendant placed his racing car on the /zoo spawn
8. On 2026-07-03 at approximately 12:10:50 EST the Defendant gave the Plaintiff a chest instead of the racing car
9. On 2026-07-03 at approximately 12:11:03 EST the Defendant disappeared from /zoo
10. On 2026-07-03 at approximately 12:11:47 EST the Plaintiff attempted to contact the Defendant via /msg but the Defendant blocked /msg (via /ignore) from vaiiss
11. On 2026-07-03 at approximately 12:32:04 EST the Plaintiff did /about MyHeartMan showing that MyHeartMan has a total playtime of 1d 29m and 50s (more than 6h + a 30 minute delay between the contract and /about command)
12. As of 2026-07-07 aprox 7:01 EST , vaiiss has a total playtime of 8d 10h 3m 50s and a playtime of 2d 17h 41m 40s in the last 7 days, therefore vaiiss had 5d 16h 22m 10s (8d 10h 3m 50s - 2d 17h 41m 40s) of playtime 7 days ago
13. Fact 11 and 12 show Capacity under the Contracts Act proving that a contract was formed as defined under Contracts Act §4.2
14. On approximately 2026-07-05, NameMC records confirm the Defendant changed their Minecraft username from MyHeartMan to LarpTiktok. LarpTiktok is the Defendant's current discord display name, and their Discord profile links a YouTube channel referencing the MyHeartMan username, confirming the identity of the user across both platforms.
15. On 2026-07-07 at approximately 7:44 EST, legal counsel for the Plaintiff (unalign) did a Discord bot /pay transaction of $0.01 to LarpTiktok's discord account, which verified that the specific Discord account contacted by the Plaintiff is directly linked to the Defendant's Minecraft account.
16. On 2026-07-04 at approximately 13:45 to 20:30 EST, the Plaintiff contacted the Defendant's Discord account in a good faith attempt to retrieve the $1,000 out of court.
On 2026-07-04 at approximately 20:51 to 21:11 EST, the Defendant replied on Discord, claiming that the discord account is shared with their brother, but attempted to evade liability by claiming their brother was the one playing and scamming.
17. On 2026-07-04 at approximately 20:57 EST, the Defendant promised to ask their "brother" to return the money as soon as the "brother" came home.
18. On 2026-07-06 at approximately 10:46 EST, the Plaintiff sent a message to the Defendant on Discord asking, "did you ask your brother about it?", but the Defendant had blocked the Plaintiff on Discord to avoid fulfilling the contract or returning the funds.
III. CLAIMS FOR RELIEF
1. Failure to Deliver Goods or Services under Redmont Civil Code Act Part VI §4 as the Defendant failed without lawful excuse to deliver goods or services (the racing car) that they have agreed to supply under a valid transaction or contract (see fact 5 and 13) and intentionally blocking the Plaintiff from reaching the Defendant through DemocrayCraft and Discord from attempting to resolve this.
IV. PRAYER FOR RELIEF
The Plaintiff seeks the following from the Defendant:
1. A racing car in Specific Performance for Failure to Deliver Goods or Services.
2. 200 Civil Penalty Units ($20,000) for Failure to Deliver Goods or Services.
3. 30% ($6,300) of the case value ($21,000) in Legal Fees.
