Amend changes to the constitution

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as “The pugbandit People’s Choice Constitution Amendment Act February 2021”.​
(2) This Act shall be enacted immediately upon its signage.​

2 – Reasoning and Notes
(1) This bill aims to give the people a say in who represents them and it is a disgrace that the people get no say in who their representative or senator is -once a previous member of Congress has resigned. This bill strikes a balance between tiring out the people with elections and also ensuring and recognising that people’s opinions may change and that the last election result cannot be used at all times.​
(2) The fact that certain members can be appointed without even participating in an election and showing their policies to the people is also a complete and utter tragedy to democracy.​
(3) We do not want the majority party to push through their candidates without a say from the people.​
3- Amendments in wording to be put in the Constitution
(1) The section titled “Removing a Member of Congress” under “Section I- The Congress” consisting of “If a Representative or Senator is no longer fit for office, they can be removed from Congress early by the relevant presiding officer with the consent of all members of their chamber (Excluding the individual in question). When a Representative or Senator resigns or is removed from office, they will be replaced by any player nominated by the presiding officer. The nominee is, by convention, the player with the next most votes in the most recent election.” shall be replaced.​
(2) The replacement shall be under the new title of “Procedures for the removal and replacement of Congress members”. This shall consist of:​
i) “If a Representative or Senator is no longer fit for office, they can be removed from Congress early by the relevant presiding officer with the consent of all members of their chamber (Excluding the individual in question).”​
ii) “After a member of Congress has resigned or been removed: The relevant presiding officer is obligated to review the most recent election, if within 14 days of resignation or removal, to nominate the next winning candidate according to the electoral system used in the election. The nominee must receive a supermajority in both chambers in order to become a Representative or Senator. Congress must vote on a nomination or motion for a special election within four days of the resignation. A special election will be automatically triggered where there are no suitable candidates in the most recent election.”
iii) “If there is an election coming for the position in question in the next 14 days a nomination can occur under the same guidelines as said above.”
iv) “If an election has not happened in the last 14 days or is not about to happen in the next 14 days for that position- a mandatory special election shall be called immediately.”​
v) “A special election shall work the same as a normal election however only the seat of the previously resigned/removed member shall be up for election. There shall not be a caretaker mode when a special election occurs. A special election shall consist of a 48 nomination period and 24 hour voting period.”
vi) “If during the nomination period other members in Congress resign or are removed (from the same chamber), then the special election results can decide who can take the multiple seats that are vacant.”​
4- Changes to be enacted summarised
(1) A special election shall be called if a member of Congress (Representative or Senator) has been removed or has resigned.​
(2) If an election has not happened in the last 14 days or is about to happen in the next 14 days, then Congress can nominate based on a previous election’s result going from the most voted candidate (which has not been elected already for the position) to the least. After the nomination has passed through a supermajority in both chambers, the player may take the seat.​
(3) A special election shall have a nomination period of 2 days and a voting period of 3 days.​
(4) Specific scenario situations are detailed above in the Constitution amendments.​

To amend the law relating to nominating legislative nominations.

The people of Democracy Craft, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the “People’s Choice Amendment Act”.
(2) This Act applies to any future nominations made after this bill is signed into law.

2 - Reasons
(1) The wording of this bill, which had me elected, does not take into account the current electoral system of proportional representation.
(2) The prescribed time period is unnecessarily long.

3 - Terms
The following clauses are amended:

(1) “After a member of Congress has resigned or been removed. Firstly, there shall be a check on whether an election (for that position in question) has been held in the past 14 days of the removal/ resignation of the Congress member (Representative or Senator). If this is the case the Congress must decide the replacement through nominations. The Congress must nominate and vote on all members starting from the candidate with the greatest number of votes from last election (that was held for that position and disqualifying candidates who have already got the position). The Congress will go through the list of candidates from the most votes to the least votes till a candidate receives support through a supermajority in both chambers. The candidate may take their position as a Representative or Senator. Congress will have 4 days to decide a replacement. If not, a special election shall be called. A motion can also be called for a special election in this period if Congress deems it to be necessary.” is changed to 'After a member of Congress has resigned or been removed: The relevant presiding officer is obligated to review the most recent election, if within 14 days of resignation or removal, to nominate the next winning candidate according to the electoral system used in the election.
