A BILL TO

AMEND THE CONSTITUTION







The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:


PART I — PRELIMINARIES

1. Short Title and Enactment


(1) This Act may be cited as the ‘Reduce The Ballooning Docket Act Part 1’

(2) This Act shall be enacted immediately upon its signage.

(3) This Act has been authored by Stanley582 and inspired by the writings of SmallFries4.

(4) This Act has been co-sponsored by Juniperfig.

(5) This Act amends the following acts:

(a) Constitution

(1) The District Court is currently overwhelmed with cases.

3. Amendments

(1) Section 15 of the Constitution shall be amended as follows:

"
15. District‌ ‌Court‌ ‌of‌ ‌Redmont‌ ‌
The‌ ‌District‌ ‌Court‌ of Redmont ‌hears ‌all‌ ‌minor‌ ‌civil‌ ‌and‌ ‌criminal‌ ‌disputes‌ ‌in‌ ‌the‌ ‌first‌ ‌instance.‌

(1) Presiding Officers. District Court cases are presided over by ‌a‌ ‌single‌ ‌Magistrate‌.‌ ‌

(2) Magisterial Elections. 2 Magistrates shall be elected to serve on the District Court.

(a) Magisterial elections shall be conducted through a system of Single Transferable Vote.

(b) In order to run in a Magisterial election, a player must:

(i) be an attorney; and

(ii) not be disbarred.

(c) Magisterial elections shall occur in February, April, June, August, October, and December, with a 72 hour declaration period occurring at the start of each election month and a 48 hour voting period taking place immediately following the declaration period.

(d) In order to vote in a magisterial election, a player must be a licensed solicitor, barrister, or attorney

(e) Magistrates elected in Magisterial elections shall have a term length of 2 months.

(i) If a magistrate is presiding over a case and their term as a magistrate ends, they may choose either to continue presiding over that case or to allow another Judicial Officer to preside over it.

(2) Section 21(1) of the Constitution shall be amended as follows:

"
(1) Magistrates are either:

(a) elected to serve on the District Court pursuant to section 15(2) of this Constitution; or

(b)
appointed by the Supreme Court to serve on the District Court.

(ai) A Magistrate appointed in this way may be removed by the Supreme Court at any time.
