TO
Provide for the RBA and Amend the Constitution​

The people of Democracy Craft, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the “RBA Reform Act”
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been proposed by: Representative RelaxedGV
(4) The Act has been co-sponsored by: Senator Milqy, Representative Mhadsher101, Senator f6rn, and Representative xLayzur.

2 - Reasons
(1) For a long time the RBA has been regarded as “Useless” or that it “does not serve a purpose.” This bill is to counteract these messages with a complete restructure, and reformat of the RBA.
(2) This bill has been approved by the current RBA Chairperson Milqy, and has been constructed with countless hours of criticism, and suggestions for the roles and powers of the RBA.

3 - Goal of the RBA
(1) The goal of the Redmont Bar Association is to have a clear area for Lawyers that is separate from government control. The association will be able to conduct all of the internal affairs without having to go through a public vote, unless outlined elsewhere.
(1) The Redmont Bar Association will consist of one elected Chairperson, and 4 elected Council Members.
(2) The elections for these roles will be held every odd month, at the 1’st of the month.
(3) The current Council and Chairperson will hold office until the next Odd month, and will then be replaced by the incoming Council and Chairperson elected.
(2)The Redmont Bar Association will hold the right to disbar
(1)This will be kept in check by a panel of select lawyers, who will be elected by the council.
(1) They must have a simple majority to be elected to the position.
(2) They will be a part of the Ethics Committee established by a previous RBA Council.
(2)The following reasons are why someone may be disbarred by the RBA, but are not limited to.
(1) Violating attorney-client privileges.
(2) Excessive Filing of Frivolous Court Cases.
(3) Committing Perjury.
4 - Public Defender Program
(1) The Public Defender Program Director will be in charge of the managing and hiring of Public Defenders. The Director will be chosen by the RBA Chairperson, and will serve the RBA in a manner befitting the RBA Public Defender Program.
(1 )The Public Defender Program will have a requirement of less than $15,000 in your personal balance, and company balance combined, to be able to take advantage of the free representation.
(2)The Director will be able to add extra quizzes or tests for aspiring Public Defenders to take before acceptance into the program. The Director will request the RBA Chairperson when payment to a Public Defender is needed. The Director will not have complete authority over the Public Defender program.
(3)The Director can be removed from their position with a simple majority vote from the Council.
(4)A Public Defender works for the Director, and is charged with taking cases for the citizens of Redmont that are unable to acquire a private lawyer, or have less than $15,000.
5- RBA Chairperson
(1) The Chairperson of the Redmont Bar Association is charged with upholding the stability and unification of the RBA. They are to move motions into votes, and to tie-break if there is a tie on a motion. The Chairperson is able to vote on motions, as long as there is no conflict of interest involved in the motion. The Chairperson is also to appoint any Committee Directors, and act as the speaker for the RBA.
(1) If the Chairperson is to resign in the middle of the term, they are to open a DoS ticket beforehand and inform the DoS that a special election is needed to fill the seat of the Chairperson.. This is to maintain order, and so that the RBA does not get into a time where they can not motion or improve the RBA.
(1) The Chairperson is able to nominate the runner up for Council to vote on, if there is a resignation. However, it does not need to be a nomination and can go to DoS for a special election.
(2) If the Chairperson of the RBA gets disbarred in the middle of the term, they are to open a DoS ticket and inform the DoS that a special election is needed to fill the seat, and they are not able to do any RBA activities from the moment they are disbarred to the event the election happens.
(1) The Chairperson should inform the DoS of this within 24 hours from being disbarred.
(3) Only the Chairperson is allowed to spend RBA Funds granted by the Government. The Chairperson is not allowed to hand this duty off to a member of the Council.
(4) To run for Chairperson the player must have:
(1) 24 hours Playtime Total, 12 hours playtime in the last 30 days, hold the “Attorney” job in game.
(2) This is to ensure that an inactive player will not be able to run for Chairperson.
6- RBA Council
(1) The role of the Council is to propose motions to the Chairperson for the betterment of the Redmont Bar Association. They are to remain active throughout their term and vote in a timely manner on motions within the Council. The Council is also charged with voting the members of the Ethics Committee in. The Council is also to remain unbiased when voting on motions, and disbarments when it comes onto the docket.
(1) If a Council member resigns mid term the Council member is to inform the Chairperson of their resignation beforehand, so the Chairperson is able to make the respective decisions to continue the RBA without disruption.
(1) Follow point 3.1.1
(2) If a Council member is to be disbarred for any reason during the term they are to follow point 4.1.
(3) To run for Council you need to have 12 hours active playtime in the last 30 days, and hold the “Attorney” job in game.
(2) If the Redmont Bar Association is to get sued the Chairperson is to defend the association.
  1. The Chairperson is able to appoint someone to defend the Association with a majority vote from Council. If there is a conflict of interest in the vote then that Council member will abstain from the vote, and the Chair will vote in the Council members place.
(3) Any member of the Judiciary is able to hold a position in the Redmont Bar Association Council or Chairperson seat.
(1) If a Conflict of interest should arise mid-term for the member of the Judiciary, the Chairperson or Council Member will temporarily resign until the conflict of interest has passed.
(1) A conflict of interest can be but not limited to, a lawyer suing the RBA for being disbarred and the Judge presiding is a member of the Council, or the Chairperson. A lawyer wishes to join the Ethics Committee, but is currently in court with the Judge presiding over the case.
7- A new sub-section
(1) A new sub-section will be created under the “Speaker of the House” titled “Redmont Bar Association.
(2) As to not clog up the Constitution, this will be placed in a drop down tab, than can be easily accessible for aspiring members of the Redmont Bar Association.

8 - Dealing with laws that contradict
(1) Any law or bill that is in conflict with this bill shall be rescinded.
 
Nay - a third party association doesn't need to be constitutionally protected
