Reform the RBA​

The people of the Commonwealth of Redmont, through their elected Representatives and Senators in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the “RBA Reform Act”.
(2) This Act shall be enacted immediately upon its signage.

3 - Reasons
(1) The RBA in its current form exists in a state of limbo between being a state organization and an independent body.

4 - Terms
(1) The Legal Board Act is, in its entirety, repealed.
(2) The Redmont Bar Association may continue to exist as a truly independent group, if it chooses to do so.
(3) The Attorney General shall not have any official powers within the Redmont Bar Association, unless the Redmont Bar Association otherwise decides to grant the individual holding the office any powers.
(4) While the Redmont Bar Association may retain its power to disbar lawyers, this does not result in the lawyer losing their ability to represent themselves or others in Court. Being a Redmont Bar Association endorsed lawyer shall hold no additional formal powers or duties, but may act as a certification of qualification.
(5) All lawyers who lost their ability to represent themselves or others before the passage of this bill shall have this right restored.
 

Veto

This bill has been vetoed for the following reasons:

1. The overwhelming majority of the prosecutor management process is established by the Legal Board Act, so repealing it entirely inadvertently repeals most specifics regarding the Office of the Attorney General’s oversight of prosecutors.

2. The bill has no provisions for government management of the public defender program. Public defenders are referred to as public defenders because they are managed by a public entity, the government, rather than a private one. By simultaneously removing the RBA’s association with the government and its legal requirement of overseeing the public defender program, we do one of two things: should the RBA discontinue the PDP, we subject Redmont’s most impoverished citizens to a lack of legal representation, or should the RBA continue public defender management, we remove direct subsidization of the public defender program, making the funding process more difficult for the RBA.

3. I agree that the Legal Board Act’s provision of unilateral RBA authority over disbarment is cringe, but this will be solved by the Modern Legal Board Act by transferring such power to the courts.

4. I agree that the way that RBA Council elections are currently managed as specified by the Legal Board Act is cringe: although I have no doubts regarding the integrity of my attorney general, the right of lawyers to a secret ballot is tainted by direct AG oversight of RBA elections and creates the potential for rigging. However, this will also be fixed by the Modern Legal Board Act.

5. Several invested members of the legal community have urged me to veto this bill for various reasons, but the most convincing argument brought to me was that consistent government support of the Redmont Bar Association has cultivated interest and legitimacy in the legal profession on a level that a private union could not. Some of Redmont’s finest lawyers, including Attorney General nnmc and Supreme Court Justice SumoMC, have been RBA Chairman and developed their legal careers via the board. I see the complete removal of state sponsorship of such a complex profession as detrimental.
