Amend changes to the constitution

The people of Democracy Craft, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as “Pugbandit's People’s Choice Constitutional Amendment (V) Act December 2020”
(2) This Act shall be enacted immediately upon its signage.

2 – Reasoning and Notes
(1) For too long has there been a hazy process of where a member has been removed- and the people sit with no say in who their next representative will be. Sometimes, the next most voted person’s popularity from the last election has gone down and if not then they should be able to show it in a mandatory special election. The people should not be denied the right to vote.
(2) We do not want certain parties to push through their candidate into power- it should be down to the people.​
(3) If an election has happened within 14 days of the removal or resignation of a candidate then the candidate with next number of votes can be nominated by the presiding officer with consent of all members of their chamber (excluding the individual in question)- this is because if an election has happened so recently the people’s time should not be wasted as they have recently given their views. And this process of nominating the person with the next largest number of votes in the last election should also apply if there is an election in the next 14 days after the removal of a member as the people will be able to have their say in the matter soon anyway.​
(4) The people will not get tired of voting as we forget voting is not mandatory and these special elections will not disengage voters as they do not have to vote in these elections, there is no excuse for not allowing the people to have a say.​

3- Amendments in wording to be put in the Constitution​
(1) The section named “Removing a Member of Congress” under “Section I – The Congress” of the Constitution, consisting of “If a Representative or Senator is no longer fit for office, they can be removed from Congress early by the relevant presiding officer with the consent of all members of their chamber (Excluding the individual in question). When a Representative or Senator resigns or is removed from office, they will be replaced by any player nominated by the presiding officer. The nominee is, by convention, the player with the next most votes in the most recent election,” shall be removed.​
(2) The section named “Removing a Member of Congress” under “Section I – The Congress” of the Constitution will be replaced with a new section named “Replacing a Member of Congress” consisting of:​
a) “If a Representative or Senator is no longer fit for office, they can be removed from Congress early by the relevant presiding officer with the consent of all members of their chamber (Excluding the individual in question). “​
b) “When a Representative or Senator resigns or is removed from office, a special election is called for this seat.”​
c) “A special election will consist of all rules of a normal election under “Section I – The Congress – Elections, but only contesting for the one seat in question and taking place a week after the previous member of Congress has been removed/replaced and with only 2 days to vote."​
i) “If during the 3 days of campaigning in a special election any more candidates resign or are removed - more seats can be fought for in the upcoming election."

d) “However, if an election has happened before 14 days of the resignation or an election is due to happen in the next 14 days after the removal of a member, the candidate with next largest number of votes from the last election can be nominated by the presiding officer with consent of all members of their chamber (excluding the individual in question)”​
i) “If that candidate is not able to take the seat- the next candidate with the most amount votes shall be nominated and so forth.”​
ii) “If all candidates are unable to take the seat in this scenario a special election will be called.”​
iii) “If from 14 days after the last election, a new member still has not been decided by Congress, then the decision shall go to a special election.


4- Changes to be enacted summarised​
(1) When a Representative or Senator resigns or is removed from office, a special election is called for this seat.​
(2) A special election will only contest for the one seat in question and will take place a week after the previous member of Congress has been removed/replaced and in a special election the people will only have 2 days to vote.​
(3) If an election has happened before 14 days of the resignation or an election is due to happen in the next 14 days after the removal of a member, the candidate with next largest number of votes from the last election- can be nominated by the presiding officer with consent of all members of their chamber (excluding the individual in question. If that candidate is not able to take the seat- the next candidate with the most votes shall be nominated and so forth. If all candidates are unable to take the seat in this scenario a special election will be called​
