CONGRESS OF THE
COMMONWEALTH OF REDMONT






A BILL TO

AMEND THE CONSTITUTION







The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:



PART I — PRELIMINARIES

1. Short Title and Enactment


(1) This Act may be cited as the ‘Public Defender Definition Act’

(2) This Act shall be enacted immediately upon assent.

(3) This Act has been authored by Deputy President of the Senate True Darklander with input from Chief Justice Small Fries.

(4) This Act has been sponsored by Speaker of the House Anton Fontaine.

(5) This Act has been cosponsored by Deputy President of the Senate True Darklander.

(6) This Act amends the Constitution.

2. Reasons and Intent

(1) Narrowing the use of the Public Defender system to only active players, and only in Criminal cases

(2) The law does not specify the scope of the Public Defender programme.

PART II — AMENDMENT

3. Amendment to the
Constitution

(1) Part II, Section 14 of the Constitution shall be amended as follows:

“14. Role‌ ‌of‌ ‌the‌ ‌Federal‌ ‌Court‌ ‌System‌ ‌of‌ ‌Redmont
The‌ ‌Judicial‌ ‌arm‌ ‌of‌ ‌Government,‌ ‌consisting‌ ‌of‌ ‌the‌ ‌District‌ ‌Court,‌ ‌Federal Court,‌ ‌and‌ ‌Supreme‌ ‌Court,‌ ‌ interpret‌ ‌the‌ ‌law‌ ‌as‌ ‌written‌ ‌by‌ ‌the‌ ‌legislature‌ ‌and‌ ‌administered‌ ‌by‌ ‌the‌ ‌Executive.‌ The Judicial arm of Government shall also establish and maintain a Public Defender program to provide the assistance of legal counsel.

(2) Part II shall be appended with the following Section:

23. The Public Defender Program:

(1) The Public Defender program is established to ensure fair representation for the citizens of the Commonwealth.
(2) The Supreme Court shall maintain and regulate the Public Defender program
(a) The Public Defender program shall provide the assistance of legal counsel, free of charge, to citizens of the Commonwealth in criminal prosecutions.
(b) A citizen, in order to be eligible to receive the assistance of legal counsel under the Public Defender program, must have:
(i) Joined the server in the last 14 days; or
(ii) Be an active citizen; and
(iii) Has appeared in their court summons
(c) The Supreme Court may establish additional regulations and limits to the Public Defender program, to establish reasonable limits to its use


(3) Subsequent Sections shall be renumbered appropriately.
