Amend the Constitution​

The people of Democracy Craft, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the “Presidential Runoff Amendment Act”.
(2) This Act shall be enacted upon receiving a super-majority in both chambers of Congress, Presidential Assent, and majority through Public Referendum.
(3) Authored by Representative 218218Consumer.

2 - Reasons for Proposal
(a) The Department of State currently has the jurisdiction to set the time period of a runoff election without any regulation of the law. The timing of elections should be determined by a legal code, not at the discretion of the executive: while the previous election was held responsibly, there should be a set time for when the runoff election will be held to prevent future abuse.
(b) There is no mechanism for breaking a tie after a runoff.
(c) The inclusion of more than two candidates in a runoff in the event that several candidates tie for 2nd place in the first round of voting defeats the purpose of a runoff, which is to guarantee that the winner has the support of a majority of voters.

3 - Terms
"If no candidate receives an outright majority in the Presidential election, a runoff election shall be held at the soonest time possible in which only the two highest voted candidates shall be listed on the ballot. In the event that more than two candidates tied for first place, all candidates which tied for first place shall be listed. In the event that one candidate received a plurality and multiple candidates tied for second, the highest voted candidate plus all candidates which tied for second shall be listed."

"If no candidate receives an outright majority in any Presidential election, a 24-hour runoff election shall be held at the soonest time possible in which only the two highest voted candidates shall be listed on the ballot. In the event that more than two candidates tied for first place, all candidates which tied for first place shall be listed. In the event that one candidate received a plurality and multiple candidates tied for second, the highest voted candidate plus all candidates which tied for second shall be listed. In the event of a tie during a 2-way runoff, the House shall decide among the runoff presidential candidates the next president and the Senate shall decide among the runoff vice presidential candidates the next vice president."

4 - Nullification
This amendment shall be automatically repealed as soon as the Single Transferable Vote Amendment is implemented by staff.
