Introduction to the Oakridge Bylaws
1. Contained on this Bylaws page, the Town Constitution page, and the Oakridge Building Regulations page are all laws applicable within the borders of the town of Oakridge.
2. The Acts of Council thread acts solely as a history of amendments to the town's laws.
Local Crimes
1. Disorderly Conduct
a. Definition: Disorderly conduct is defined as the act of disturbing a crowd of five or more people in a manner that a reasonable person would find threatening to his/her safety.
b. Classification: Summary Criminal Offense
c. Per Offense:
i. First Offense: Verbal Warning + Removal From Crowd
ii. Second Offense: $120 Fine + Removal From Crowd
iii. Third Offense: $150 Fine + 5 Minutes Jail
2. Misuse of the Post Officea. Definition: Any use of the post office where an illegal item is shipped or shipped with the intention of filling a P.O box with unnecessary items.
b. Classification: Summary Criminal Offense
c. Per Offense:
i. First Offense: Verbal Warning + Punishment of any other law violated
ii. Second Offense: $50 Fine + Suspension of offender's access to postal service for 1 month + Punishment of any other law violated
iii. Third Offense and Beyond: $150 Fine + Permanent suspension of offender's access to postal service (appealable) + Punishment of any other law violated
Eminent Domain Act
1. The Head of Urban Development, when in agreement with the Head of Residence and Town Attorney General, on behalf of the Town of Oakridge, may acquire privately owned property for public works programs, necessary infrastructure, and town development.
2. Prior to acquisition, the Head of Urban Development will negotiate with the property owner and make a fair offer for the property. Compensation may include a cash offer to cover any difference in value or a plot trade of similar size or value.
a. If the property owner fails to respond after a period of 72 hours, the Head of Urban Development may pursue eminent domain of the owned plot through a court order.
3. If the Head of Urban Development decides to pursue eminent domain, they must provide criterial justification for its necessity.4. Property owners have the right to defend their property in court and may contest the adequacy of the cash payment if they are willing to sell it but feel it is insufficient.
5. The presiding Judicial Officer may increase or decrease the cash payment if deemed appropriate but not reduce it below the plot's in-game price. The presiding Judicial Officer also has the authority to deny the claim and uphold the Mayor's cash offer if an eminent domain order is granted.
6. Eminent domain may only be issued if any of the following criteria are met:
a. The property is essential for building necessary infrastructure, such as roads, walkways, medical facilities, police stations, and government buildings;
b. The property obstructs the town's development or infrastructure project.
Oakridge Property Standards Act
1. Oakridge has building regulations as per the Oakridge Building Regulations page.
2. The Head of Residence and Mayor in agreement may create building regulations outside of this Act, if not overridden by an Act of Council, or in conflict with another law.
3. All building regulations and property laws applicable to Oakridge plots will be established under the Oakridge Building Regulations page.
4. The town of Oakridge shall retain jurisdiction to evict properties in accordance with these laws and regulations.
Oakridge Property Tax Act
1. Per plot, per month, each Oakridge plot owner shall be taxed the following Property Tax: $0.
a. In accordance with the Taxation Act, the Federal Government shall conduct this taxation.
Legislative Process Act
1. All Council Members have the ability to officially propose bills to the Town Council. In order to propose a bill, Council Members must follow the legislative process outlined in this Act.
2. A bill is first proposed by being posted into the Oakridge Council thread with the prefix 'Bill: Draft'.
a. All bills that amends the Town Constitution must exclusively amend the Town Constitution.
3. In order to be put to vote, a bill must have at least one co-sponsor.a. A co-sponsor must be a Council Member who is not the poster of the bill and must be willing to be listed as a co-sponsor.
4. The Chief of Staff will put a bill to vote by changing the bills prefix to 'Bill: Vote' and by alerting Council Members of the vote in #┃𝐕𝐨𝐭𝐢𝐧𝐠 on Discord.
5. Voting will be opened for 48 hours.
6. In order for a bill to pass the Town Council, it must be voted on by a majority of the Council Members and must receive a majority of votes in favor. In the event of a tie, the Deputy Mayor of Oakridge shall decide whether it passes or fails.
a. A bill that amends the Constitution of Oakridge must receive a supermajority votes in favor to pass the Town Council.
7. In order for a bill passed by the Town Council to be made into law, the Mayor must approve and sign the bill into law. If the Mayor does not approve, they shall return it to the Town Council, with objections. The Town Council may, with a supermajority vote of approval among its members, override the Mayor's objections and have the bill made into law.a. If the bill is passed, the prefix of the bill will be changed to 'Act of Council' and the bill will be moved to the Acts of Council thread.
b. If the bill has failed, the prefix of the bill will be changed to 'Bill: Rejected' and the bill will be moved to the Rejected/Rescinded Bills thread.
Chief of Staff Act
(1) The Chief of Staff is a public servant of the Town of Oakridge who bears the following responsibilities:(a) Facilitating voting on bills proposed by the Town Council, and ensuring their timely passage.
(b) Advising the Mayor on matters relating to the Executive.
(c) Assisting the Town Council in the operation of their offices.
(2) The Chief of Staff must be proposed by a motion of the town council and approved with a simple majority.
(3) The Chief of Staff may be removed with a supermajority of the Town Council voting in favor of removal.
(4) The Chief of Staff will serve a term that is concurrent with the Town Council, their term will conclude upon the election of a new Town Council.
Economic Growth Plan Act
(1) The Office of Commerce is authorised to create a town-owned commercial bank which is to take deposits and be the investment vehicle for the Economic Growth Plan.
(2) The Head of Commerce is authorised to draft and submit Incorporation filings for a corporation to fulfill this purpose. The corporation will be a governmental entity under §2(1)(c) of the Legal Entity Act only following the initial approval of all corporation filings by the Department of Commerce.
(3) At inception, this bank will be owned by the Town of Oakridge in its entirety.
(4) The Office of Commerce is authorised to hold, acquire, and sell Reveille properties.
(5) The Oakridge National Bank is required to follow all requirements listed in the following subsections, as well as current financial regulations, and Executive Orders.
(a) ONB must primarily invest Economic Growth Plan proceeds into FRB products and securities, loans to businesses registered with the Office of Commerce, and loans to the federal government.
(b) ONB may not at any time allocate more than 30% of the funds destined from the treasury to the Economic Growth Plan towards Real Estate investments.
(c) ONB will minimize operating costs wherever it is reasonable to do so.
(d) In case of a short term cash shortage, the town may divert money into the Oakridge National Bank, if there is no quick solution.
(6) Initial allocated funds are to be $1,000,000, with any further allocations requiring the approval of the Mayor.
(7) No further allocations may leave the Town of Oakridge treasury with less than $800,000 in its balance at any time.
(8) Should the Oakridge National Bank require legal assistance of any kind, whether that be compliance, lawsuits, etc., the Oakridge Office of Legal Affairs is required to assist.
(9) Distribution of profits, as well as details not mentioned in this bill, shall be determined by the Certificate of Incorporation.
(10) The Office of Commerce will gather monthly financial overviews of the Oakridge National Bank to be presented to the Mayor, Deputy Mayor and Council every month.
Emergency Auction Act
3 - Definitions
(1) "Town Auction proceeds" or simply "Proceeds", is to be defined as: The money that the auction winner paid to win the auction.
4 - Handling of Proceeds
(1) The Town Eviction Tax is set to 100%.
(2) This is to be regardless of the type of plot up for auction, previous ownership, or other factors.
(3) This is to be collected by the Mayor.
Property Registry Act
3 - The Property Registry
(1) The Head of Residence is charged with maintaining, and establishing a public property registry.
(2) To be eligible to use the property registry, a company must be registered with the Office of Commerce.
(3) A company registered with the Office of Commerce, may only have the plots registered under their account, held by the in game owner of the DB.
(4) Up to 2 properties may be registered with a singular company's account.
(a) No benefits may be withheld due to only having 1 or 2 registered properties.
(5) A company using the property registry, has an "account", under which their plots are registered.
(6) No player may have multiple companies registered under them with accounts at the same time.
4 - Payment
(1) There is to be a $400 per week charge, which is to be delivered to the town government account.
(a) This can be prepaid for up to 4 weeks at a time.
(b) If by the Thursday of any given week, the payment has not been delivered, their account is considered as elapsed.
(c) Elapsed accounts do not enjoy any of the benefits.
(2) This only applies for a company that has a Property Registry Account.
5 - Oakridge Inc.
(1) Any business, including ones that are not registered with the Department of Commerce (DOC), may open a ticket with the Office of Commerce to register with the Office of Commerce.
(2) To register, they must give the /db (or subsequent plugin) of the business, and any ties/plans it has with/for Oakridge.
(3) A business registered wtih the Office of Commerce is to be a part of the Oakridge Business Association.
(4) Businesses registered with the Office of Commerce may seek a loan from the Oakridge National Bank.
(a) This is only to take effect when it opens up to the public.
Refresh Grants Act
3 - Definitions
(1) For the purposes of this Act, "company" is to refer to any legal entity registered with the Department of Commerce.
4 - Grant Categories
(1) The following grant types are established under the Business Grants category:
(a) Business Startup Grant
(i) This grant is intended for new businesses in need of funds to purchase tools, rent, property, etc., to jumpstart production, sales, or services.
(ii) A maximum of $15,000 may be awarded through this grant.
(b) Business Expansion Grant
(i) This grant is intended for established businesses to purchase property, renovations or anything else needed to facilitate the expansion of their business into Oakridge. The applicant must not own commercial property in Oakridge.
(ii) A maximum of $12,500 may be awarded through this grant.
(c) Business Property Grant
(i) This grant is intended for businesses both new and established to purchase commercial property in Oakridge. The applicant must not own commercial property in Oakridge.
(ii) A maximum of $10,000 may be awarded through this grant.
(d) Crisis Recovery Grant
(i) This grant is intended for businesses recovering from unexpected crises or economic downturns, in need of funds to regain stability.
(ii) A maximum of $7,500 may be awarded through this grant.
(e) Sectoral Grant
(i) This grant is intended to fund start-ups, advancements, and innovation within specific industries. The applicant must own a business in one of the following industries: Lumber; Newspaper/media; Food service; Arts; Arms; Vehicles; Manufacturing; or Tourism.
(ii) A maximum of $10,000 may be awarded through this grant.
(2) The following grant types are established under the Activity Grants category:
(a) Active Business Bonus Grant
(i) This grant is intended to encourage businesses to stay active within the town. The applicant must own a business, and must keep that business stocked, active, and operational.
(ii) A maximum of $4,000 may be awarded through this grant.
(iii) This grant must be renewed once a month if the applicant continues to desire the grant money.
5 - Grant Handling
(1) The Commerce Office is tasked with handling grant applications.
(2) The amount of money awarded for each grant is at the discretion of the Commerce Office.
6 - Oakridge Business Association
(1) Any company registered with the Office of Commerce is allowed to seek up to 30% more than the usual limit for each grant type.
