A
BILL
TO

Amend the Constitution

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the "No Presidents In Congress Allowed Act"
(2) This act shall take effect upon signage
(3) This act is co-authored by: Representative 1950minecrafter and Representative TheReal42Person
(4) This act is cosponsored by: Representative TheReal42Person

2 - Reasons
President-Elect, according to the Constitution, has the power to nominate Secretaries to the Senate before being inaugurated. There's nowhere stating that the President-Elect nor the Vice-President-Elect have the obligation to leave Congress in case they are serving in any chamber until the inauguration. This can lead to a conflict of interest, as Senators vote for Secretary nominations, and if the President-elect is still Senator at the same time, they could be voting on their own nominations. If there's also the Vice-President, that's 2 Senators out of 6 voting in favor of the nomination almost automatically.

In order to prevent any kind of conflict of interest on this matter and preserve the Separation of Powers, this amendment is proposed.

3 - Amendments to the Constitution
PART III - THE PRESIDENT AND CABINET
24. ELECTION
Immediately following the election, the winner of such will be declared the President-Elect. The incumbent President will remain President until the 15th when the Commencement of the President-Elect's term as President will begin.
Add:
Immediately following the election, the winner of such will be declared the President-Elect. The incumbent President will remain President until the 15th when the Commencement of the President-Elect's term as President will begin. The President-Elect and/or Vice-President-Elect shall automatically be removed from any position they may be serving in Congress after the results have been announced and special elections for their seat in Congress shall be called.
