CONGRESS OF THE
COMMONWEALTH OF REDMONT

A BILL TO

ALLOW BARRISTERS IN THE BAR BECAUSE ATTORNEY EXAMS ARE CLOSED AND THERE’S A LOT OF BARRISTERS

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

PART I — PRELIMINARIES

1. Short Title and Enactment

(1) This Act may be cited as the ‘No More Petitions & Attorneys Act’

(2) This Act shall be enacted immediately upon its signage.

(3) This Act has been authored by Vice President _GreyMC and reviewed by Judge CreeperTD.

(4) This Act has been co-sponsored by Senator HatManMC and Representative TequilaSalad.

(5) This Act amends the following acts:

(a) Redmont Electoral Act

(b) Bar Association of Redmont Act

2. Reasons and Intent

(1) Currently, all the possible candidates for a BAR countback are unable to run due to them being a Barrister or playtime. This will lead to a special with not that many candidates, as Attorney and Barrister exams are closed.

(2) Yes, Barrister exams are not currently open, but there are still a lot of Barristers. This Act will allow them to run.

(3) Moreover, this act completely removes recall referendums, as we have been shown that people will just abuse it by any means necessary. I wish we could've had them, but people just abuse anything we give them.

PART II — AMENDMENTS

3. Redmont Electoral Act

(1) §19(1)(a) of the Redmont Electoral Act shall be amended as follows:

“(a) the citizen holds at least the qualification of AttorneyBarrister;”

4. Bar Association of Redmont Act

(1) Part IV §4(1)(b-c) of the Bar Association of Redmont Act shall be amended as follows:

“(b) Petition & Referendum

(i) Any member of the BAR in good standing may propose a petition for a referendum to remove a BAR Councilor from their seat on the BAR Council.

(ii) The petition requires a number of signatures greater than 30% of the voters in the prior Council general election, and can only be signed by members of the BAR in good standing.

(iii) Upon the petition reaching the required signatures, the Department of State, open realization or notification of the petition, must put up the referendum within 48 hours.

(iv) The referendum will be open for 48 hours, and only BAR members can vote.

(v) The referendum should be phrased as a vote to keep the member in the BAR council, and will require a supermajority of all the BAR members voting to remove the individual. The two voting options should be “Retain” and “Remove”, with Retain always being the first option.

(vi) A petition may not seek to remove more than one Councilor at a time, and must clearly state the username of the BAR member, and what clause, under this Act, the individual broke.

(vii) Should an individual be removed via this method, they may not stand for the special election for their seat, but they may stand again for any other BAR Council election.

(b) Lack of Qualifications

(i) Should a BAR Councilor at any time be removed from the qualification of Attorneyfail to meet the legal qualifications required to run for the BAR Council, or face a deportation of 30 days or longer, they shall be automatically removed from their position.

(ii) A vote will not be required for an automatic removal, and should be removed by the Chairperson or another role with the authority to remove them.
”

5. Transition Period

(1) This law does not affect any referendum to retain a BAR Councilor that is up for vote.
(2) Any current petition effecting the removal of a BAR Councilor, if it has not resulted in a referendum, is null and void.
(3) These amendments do not affect any current election or countback that is running at the time of passage.

:nay: - This bill outright removes the entire process for members of the BAR to remove through referendum a BAR councilor. Evidence stated by the Vice President of the abuse of these petitions show these petitions have little to no teeth, and are ayed in joking manner. This bill makes no attempt to adjust the process to prevent such abuse, and rather decides to destroy the integral process all together.

The No More Petitions & Attorneys Act lowers the qualification needed to stand for the BAR Council from Attorney to Barrister. With Attorney and Barrister exams both closed, very few people can currently run, and the coming countback would have left us with almost no eligible candidates. There are plenty of Barristers in good standing, and opening the Council to them is a sensible way to keep it filled and active. The automatic removal rule is updated to match, so a Councillor is removed if they stop meeting whatever the legal requirements to run are, rather than being tied to the Attorney rank.

The bill also removes the petition and referendum route for removing a BAR Councillor. Recent events have shown how easily that process can be used to target Councillors for political reasons rather than misconduct, and it is fair to take it away while keeping the Council’s own Motion to Remove and the automatic removal for lost qualifications or long deportations. The transition rules are also fair, as they leave any referendum already underway and any running election or countback untouched.

However: Part IV §4(1) of the Bar Association of Redmont Act still says there are “a total of three ways” to remove a Councillor, when there are now only two, which should be tidied up. With the referendum gone, BAR members also have no way of their own to remove a Councillor who misbehaves, as a Motion to Remove needs the unanimous vote of the rest of the Council. I would welcome a future bill that gives members a safer, harder-to-abuse route if this becomes a problem.

Overall, this is a practical fix that keeps the BAR Council running while the exams are closed.

I thank Vice President _GreyMC for authoring this bill, Judge CreeperTD for reviewing it, Senator HatManMC and Representative TequilaSalad for cosponsoring it, and Congress for passing it.

This bill has been granted assent and is hereby signed into law.
