CONGRESS OF THE
COMMONWEALTH OF REDMONT






A BILL TO

PREVENT THE SCHEDULING OF SPECIAL ELECTIONS THAT WOULD CONCLUDE DURING CARETAKER







The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:


PART I — PRELIMINARIES

1. Short Title and Enactment


(1) This Act may be cited as the ‘No Elections During Caretaker Act’

(2) This Act shall be enacted immediately upon its signage.

(3) This Act has been authored by Speaker Antonfr.

(4) This Act has been co-sponsored by Representative Dan_ie_laa.

(5) This Act amends the following acts:

(a) Electoral Act

2. Reasons and Intent

(1) Special elections that conclude during caretaker mode serve no meaningful democratic purpose as the elected official assumes office only for the remainder of a dissolved Congress.

(2) This Act ensures that special elections are not scheduled where they would conclude during caretaker, preventing using resources and the Department of State's time for what is essentially a meaningless election.

PART II — AMENDMENTS

3. Amendments to the Electoral Act


(1) §8(1) of the Electoral Act shall be amended as follows:

"(1) Election Schedule. When a vacancy occurs in the House of Representatives or Senate, a special election for the vacancy will commence within 24 hours of the Department of State being notified, given:

(a) The seat is not up for election in the upcoming Congressional general election, if Congress is in caretaker mode;

(b) There is not a special election for either chamber of Congress ongoing;

(i) In this case, the special election will be scheduled within 24 hours after the conclusion of the ongoing special election(s).

(c) The special election will not conclude while Congress is in caretaker mode."
 

Presidential Assent


We don't need special elections to end while declarations and campaigning for the general election are ongoing.

This bill is granted assent and is signed into law.
