Establish Rules for the Business of the Redmont Bar Association Council
I, TheSnowGuardian, do hereby move that the following be passed by the Redmont Bar Association Council:
1. Establishment of an RBA Council: Rules of Business Page
(1) The Redmont Bar Association sub-forum shall have another sub-forum named Information and Policy.
(a) Under this sub-forum 'Information and Policy', there shall be a thread called 'RBA Council: Rules of Business'
(i) Content of the 'RBA Council: Rules of Business' thread, so as long as the content has been added to the thread by a motion that has passed with a majority of votes cast and the motion's votes meet quorum as established by the below rules, shall be the binding rules for conducting business within the RBA Council.
2. Content of Rules of Business Page
(1) The content of the 'RBA Council: Rules of Business' thread shall be as follows:
"
Rules for Conducting Business within the RBA Council
1. When a new Redmont Bar Association Council is formed after elections, the Council shall elect a Chairperson in accordance with the Redmont Bar Association Act.(a) Any Councillor may assume the seat of the Chair, (known as Chair-delegate), and assume the powers of the Chairperson for the sole purpose of counting votes during the above-mentioned election.
(i) The Chair-delegate shall not conduct business or act with the powers of the Chairperson where these rules don't specify those actions.
(b) The voting period of the above-mentioned election shall last for 24 hours.
(c) No votes cast after the voting period shall be considered.
2. The Chair-delegate shall compile the list of all nominees and shall move for an election of the Chairperson 24 hours after the last nomination.
(a) A Councillor may only nominate themself for the position of Chairperson.
(b) The motion shall contain a list of all nominees, where Councillors shall vote for only one nominee, in accordance with the Redmont Bar Association Act.
4. Once a Councillor has been elected to the seat of Chairperson, this Chairperson shall call the Council to order, and the Council shall conduct its regular business.
(a) After the conclusion of the election, and where a Councillor has been elected to the seat of Chairperson, the Chair-delegate shall relinquish their powers and will step back down to their seat as a Councillor.
(b) If a Councillor has not been elected to the position of the Chairperson within the time prescribed by the Redmont Bar Association Act, the Department of State shall hire the Councillor with the most votes as Chairperson, and it shall be assumed that the Council elected this person as Chairperson.
5. No business that is not mentioned in this section, 'A. Call to Order', shall be conducted so long as a Councillor hasn't been elected to the seat of Chairperson.
B. Motions
1. All motions shall be clear and concise in what they aim to do or achieve.
2. After a motion is moved, the Chairperson shall put it up for a vote.
(a) The voting period shall last for 48 hours from the moment it is acknowledged.
(b) Once the voting period concludes, the Chairperson shall count votes on record and shall tally them.
(i) Votes cast after the voting period ends shall not be counted.
(c) Any vote shall have the options of Aye, Nay, and Abstain.
(i) A vote that is not in clear words of either 'Aye' or 'Nay', in either text and/or emoji form, shall be counted as an abstention.
3. All motions that meet the standards for passage as defined by the Redmont Bar Association Act shall be passed.
(a) Motions that do not pass after the conclusion of the voting period shall fail.
(b) Motions that are rescinded shall be rescinded.
(c) Motions that do not meet quorum may be put for a revote.
(d) Motions that are tied shall be put up for revote without the option to abstain.
4. Motions shall be numbered as follows:
(a) 'PU-XXX' for Public Motions, where XXX shall be the sequential numbering of that motion.
(b) 'PR-XXX' for Private Motions, where XXX shall be the sequential numbering of that motion.
(c) Numbering shall apply retroactively.
B.I. Public Motions
1. A Councillor shall have the right to move things onto the public floor, except the items mentioned in the 'C. Private Motions' section.2. A list of Public Motions that shall be moved, subject to Council Rules, to voting is the following:
(a) Motion to Appropriate Funds,
(b) Motion to Conclude Investigation,
(c) Motion to Summon,
(d) Motion to Ask Congress For Appropriations
(e) Motion to Overturn the Ruling of the Chairperson,
(f) Motion to Adopt Resolution,
(g) Motion to Amend,
(h) Motion to Elect.
3. If a Public Motion is not a part of the list, then it shall require another Councillor to second it, essentially acting as peer review.
4. All Public Motions moved on the floor, regardless of consideration or passage, shall be required to be posted in the Motions thread of the Redmont Bar Association sub-forum.
(i) If the motion is considered by the Council and put to a vote, the votes on the motion shall be a part of the public record on the forums.
5. Public Motions, the public-floor, and public-voting shall be accessible to the general public.
B.II. Private Motions
1. A Councillor shall have the right to move the following items on the private floor:(a) Motion to Open Investigation,
(b) Motion to Summon,
(c) Motion to Subpoena,
(d) Motion to Conclude Investigation,
(e) Motion to Open Preliminary Inquiry,
(f) Motion to Conclude Preliminary Inquiry,
(g) Motion to Open Inquiry,
(h) Motion to Conclude Inquiry,
(i) Motion to Indict,
(j) Motion to Delegate Legal Representation,
(k) Motion to Adopt Conclusion Report.
2. All Private Motions, 30 days after being moved, shall become a part of the public record and shall be posted on the 'Motions' sub-forum of the 'Redmont Bar Association' sub-forum on the forums.
(i) If considered by the Council and put to a vote, the votes on the motion shall also be a part of the public record after 30 days of the vote being concluded.
3. Private Motions, the private-floor, and private-voting shall only be accessible to Councillors.
D. Investigative Process
1. A Councillor may move to open an investigation against a lawyer registered with the Redmont Bar Association.2. Investigations shall have, subject to procedures, the following stages:
(a) Preliminary Inquiry. This shall not include the accused lawyer, and this inquiry’s main objective is to determine whether the accusations hold merit and there is reasonable suspicion that the accused lawyer committed a disbarrable offence.
(b) Inquiry. This shall include the concerned lawyer, who shall be called to defend against the accusations made against the lawyer. Evidence shall be presented to the accused lawyer, and testimony shall be heard.
(c) Conclusion. The RBA Council shall make and adopt an investigative report that shall detail its findings, opinion, and recommended course of action based on the conduct of the concerned lawyer.
(d) Disbarment Proceedings. The RBA Council shall commence disbarment proceedings if that is the recommended course of action of an adopted investigative report, provided that the following are met:
(i) An inquiry has been conducted.
(ii) There is proof beyond a reasonable doubt
3. An investigation may be concluded at any stage should the Council pass a motion regarding such conclusion.
(a) Investigative Report(s) must be attached to the motion.
4. A preliminary inquiry shall be private. Relevant evidence shall be examined by the Council, and relevant witnesses shall be summoned to testify regarding the Conduct of the accused lawyer.
5. An inquiry shall be public. Relevant evidence shall be presented to the accused lawyer. Identity of witness(es) shall be kept private, unless the witness(es) express consent.
E. Amendments to these Rules
1. Amendments to these rules shall be made when a Motion to Amend passes.
2. When text is amended, the first message of the thread shall be updated to match the amendments.
3. A post on the thread shall detail the amendments and by what motion (and the relevant motion's motion number) it passed.
