Case Filing

IN THE DISTRICT COURT OF THE COMMONWEALTH OF REDMONT
CIVIL ACTION

Miqualex00
Plaintiff

v.

anasgamerah
Defendant

COMPLAINT
The Plaintiff complains against the Defendant as follows:

WRITTEN STATEMENT FROM THE PLAINTIFF

My partner and I were at our building when the Defendant approached and initially spoke to my partner, asking about his job. As I arrived, he asked both of us to step inside our plot so that no one else could hear the conversation. Once we were inside, he asked if we wanted to work for him doing something illegal. We immediately refused his offer. After we declined, he attacked and killed me, then attempted to kill my partner as well. Before leaving, he threatened us by saying that he knew where our building was, which made the threat feel serious and intimidating. He then proceeded to attempt to kill me whilst i was helping a new player and killed my partner twice more .

III. CLAIMS FOR RELIEF
1. The first Claim is nuisance. As defined in RCCA Part VII §6, A person commits a nuisance violation when they both, (a) cause a substantial and unreasonable interference with another’s use and enjoyment of their property; and (b) the interference would be offensive to a reasonable person in the plaintiff’s position. In this case, The defendant clearly caused a substantial and unreasonable interference by: repeatedly killing and trying to kill the Plaintiff(Facts 9,10,14,and 15), repeatedly killing and trying to kill the Plaintiff's Partner (Facts 9,10,and 13), and threatening the Plaintiff's safety on his plot(Facts 11,12 and 16).This interference prevented the Plaintiff's enjoyment of their property because you cannot enjoy property when you are dead, the Plaintiff was concerned for their partner's safety, and the Plaintiff was scared of further attacks by the defendant.

IV. PRAYER FOR RELIEF
The Plaintiff seeks the following from the Defendant:
1. A court order to abate the nuisance. This order will Compel the Defendant to stay away from the Plaintiff's plot.
2. $5,000 in punitive damages as authorised by RCCA Part VII §6.
3. $50,000 in Consequential Damages due to loss of enjoyment. Loss of Enjoyment is available where an injured party loses, or has diminished, their ability to engage in certain activities in the way that the injured party did before the harm. The plaintiff, in this case, clearly lost enjoyment because of the constant threat of attack and the repeated actual attacks.
4. Nominal Damages: In the case that no additional damages to Compensatory Damages can be awarded, and only in this case, the Plaintiff seek restitution in the form of nominal damages at $7,500 to acknowledge harm done by Defendant to Plaintiff.
5. 16,500 in legal fees, as 30% of the total amount sought($55,000)
