Add Crimes from the JSA to the Criminal Code

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the 'JSA Crimes Addition Act'
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by PoS Pepecuu.
(4) This Act has been co-sponsored by President of the Senate Pepecuu.

2 - Reasons
(1) To amend the Criminal Code Act.
(2) The passage of the Criminal Code Act has left constitutional offences in the Judicial Standards Act, which are nonstandard. Adding these to the CCA will standardise them.

3 - Additions
Part III of the Criminal Code Act is to be amended as follows:

14 - Duty to Disclose
Offence Type: Summary
Penalty:
(a) First Offense: 20 Penalty Units
(b) Second Offense: 50 Penalty Units
(c) Subsequent Offences: 75 Penalty Units; Up to 10 minutes Imprisonment
A person commits an offence if the person:
(a) Fails to present to the opposing counsel any exculpatory evidence relating to a court case that the violator is either a plaintiff, defendant, or counsel in, that was either personally viewed or received.

15 - Ex Parte Communication
Offence Type: Summary
Penalty:
(a) First Offense: 20 Penalty Units
(b) Second Offense: 50 Penalty Units
(c) Subsequent Offences: 75 Penalty Units; Up to 10 minutes Imprisonment
A person commits an offence if the person:
(a) Makes direct or indirect communication about a specific case with the presiding officer that is presiding over that case that the violator is either a plaintiff, defendant, or counsel in without the knowledge of all parties (Plaintiff, defendant, counsel) in the case.

Nay - Duty to Disclose violates Right 5 of citizens in the constitution, in its current definition. I believe some changes should be made to the 5th right in the Constitution before we illegalize not giving information in a case.
