Amend the Criminal Code Act

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the 'Honest Policing and Credit Standards Amendment Act'.
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by AsexualDinosaur, and modified by ToadKing.
(3) This Act has been sponsored by Representative zLost.
(4) This Act has been co-sponsored by PoS Omegabiebel.

2 - Reasons
(1) To prevent citizens from being misled by police officers into arrest situations.
(2) To clarify when law enforcement officers must identify themselves.
(3) To incorporate Credit Standards Act violations into the Criminal Code Act for proper enforcement.

3 - Amendments
(1) PART I: INTERPRETATION AND APPLICATION of the Criminal Code Act shall be amended by adding the following new section:

"9 - Honest Policing
(1) A law enforcement officer who is directly asked by a citizen whether they are a law enforcement officer must:
(a) answer truthfully in the affirmative; or
(b) decline to answer if they are conducting an authorised undercover investigation.
(c) An officer cannot claim undercover status when their primary purpose is to deceive a wanted person into attending a location for arrest.
(d) Silence or evasion without claiming undercover status constitutes a denial for the purposes of this section.
(2) If a law enforcement officer violates subsection (1), any arrest made by that officer during or immediately following that interaction shall be void, and:
(a) the arrested person shall be released immediately;
(b) any evidence obtained as a result of the unlawful arrest shall be inadmissible; and
(c) existing charges or wanted points arising from other lawful arrests remain valid.
"

(2) PART VII: CORPORATE OFFENCES of the Criminal Code Act shall be amended by adding the following new section:

"25 - Violation of the Credit Standards Act
Offence Type: Indictable
Penalty: Up to 100 Penalty Units
A person commits an offence if the person:
(a) omits required information when extending credit as detailed by the Credit Standards Act.
Relevant Law: Act of Congress - Credit Standards Act
"

(3) Section 6 of the Credit Standards Act shall be amended as follows:

"6 - Fines
(1) Violation of the Credit Standards Act
(i) Classification: Indictable Criminal Offence
Any omission of required information by creditors when extending credit, as detailed by the Credit Standards Act.
Minimum Sentencing: $5000 Fine
Maximum Sentencing: $10000 Fine
"
