Provide for Clarification regarding Government Fees​

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the 'Government Fee Act'
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by Omegabiebel.
(4) This Act has been co-sponsored by <user>.

2 - Reasons
(1) There is no clear definition on when government fees are purely fees and when they are taxes.

3 - General
(1) In the context of this Act, the Government shall mean any of the governmental branches, governmental agencies, governmental departments, or public entities.

(2) A fee by a private person or company is a payment in exchange for a good or service.

(3) Governmental fees shall be the fees set by the Government to offset a specific cost.

(a) The Governmental fee amount may not exceed the cost or value of the good or service.​
(b) The Governmental fee amount may not vary based on any factor other than the cost of the good or service.​
(c) The Governmental fee must be directly related to the good or service.​
(4) The Government may not require any other monetary payment for goods or services it provides other than fees unless otherwise defined by law.

(a) Auctions run by the Government shall be considered services.​
(b) Regulatory applications shall be considered services.​
(5) All payments required by the Government that don’t fall under the definition of a fee shall be considered a tax.

(a) Except for:​
(i) Penalties and sanctions as a result of breaking the law.​
(ii) Judicial verdicts.​
(b) The Executive, its departments, and agencies may set a required monetary payment considered a tax under this Act on goods (per set) and services it provides up to $500(excluding governmental fee), unless otherwise defined by law.​
(i) This payment shall only be paid once per set of goods.​
(ii) This payment shall only be paid once every cycle of service.​
(6) DOE shall be able to set a payment up to $50,000 per patent for its patent service

(7) DCT shall be able to set a payment up to $3 per non air pasted block
