Regulate Gambling within the Commonwealth

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment

(1) This Act may be cited as the 'Gambling Regulation Act.'

(2) This Act shall be enacted immediately upon its signage.

(3) This Act has been authored by Representative Scassany.

(4) This Act has been co-sponsored by Representative vvirtue_ and Senator Anthony_Org.

2 - Reasons
(1) To amend the Commercial Standards Act and the Criminal Code Act
(2) To repeal the Government Lottery Act
(3) Gambling is a largely unregulated field that should have some limitations placed upon it
(4) With the guidance from staff regading gambling, we should update our laws to match

3 - Definitions
(1) Gambling is defined as when a citizen or other entity stakes or risks something of value upon the outcome of a contest or a future contingent event not under their control or influence, upon an agreement or understanding that they will receive something of value in the event of a certain outcome.
(2) For the purposes of this act, something of value is defined as any currency or asset that may be directly or indirectly used, sold, traded, risked, or bought.
(3) A "Gaming Institution" is defined as a business that facilitates any form of gambling.
(4) "Table Gaming" is defined as any gambling played with cards, dice, or other equipment.
(5) "Illegal Gambling" is defined as any form of gambling that is not permissible under Section 4(4).
(6) "Game of Skill" means a gambling activity in which the outcome is determined predominantly by the knowledge, judgment, strategy, or skill of the participants, notwithstanding that chance may play an incidental role. This includes games like poker.
(7) "Game of Chance" means a gambling activity in which the outcome is determined predominantly or entirely by random chance rather than by the skill of the participants. This includes games such as slots, coin flips or over/under bets with dice.

4 - Regulations
(1) Gaming institutions are required to display the odds of gaming machines and activities in a visible area adjacent to the machine/activity.
(2) Gambling may not be advertised in the in-game advertisement channel.
(3) Gambling may only be payable in Redmont Dollars, the currency of a recognized foreign nation, plots, or other in-game goods or services.
(4) Gambling is allowed in the Commonwealth with the following exceptions:
(a) Where the contest or contingent event takes place outside of the Commonwealth or a recognized foreign nation.
(i) The above exception will not apply if the gambling is in the form of table gaming.

5 - Amendments
(1) Section 9 of the Commercial Standards Act shall be amended as follows:
"9 - Gaming
(1) Gaming institutions are required to display the odds of gaming machines and activities in a visible area adjacent to the machine/activity.
"
(2) Part 7 Section 9 of the Criminal Code Act shall be amended as follows:
"9 - Fraudulent Gaming Conduct
Offence Type: Indictable
Penalty: Up to 200 Penalty Units; up to 10 min imprisonment
A person commits an offence if the person:
(a) Misrepresents or manipulates the odds, outcomes, or terms of a gambling or gaming activity to deceive participants or gain unfair advantage; or
(b) Organizes or initiates illegal gambling as defined in the Gambling Regulation Act

6 - Repeals
(1) The Government Lottery Act shall be repealed.

A BILL TO

AMEND THE GAMBLING REGULATION ACT TO PROHIBIT GAMES OF CHANCE







The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:


PART I — PRELIMINARIES

1. Short Title and Enactment


(1) This Act may be cited as the ‘'Gambling Regulation (Games of Skill) Amendment Act’

(2) This Act shall be enacted immediately upon its signage.

(3) This Act has been authored by Senator Anthony_Org

(4) This Act has been sponsored by Representative juniperfig.

(5) This Act has been co-sponsored by Senator Anthony_org.

(6) This Act amends the following acts:

(a) Criminal Code Act

(b) Gambling Regulation Act

(c) Server Rules

2. Reasons and Intent

(1) Games of chance provide little meaningful player agency and encourage purely luck-based gambling.

(2) Games of chance are disproportionately harmful to new players and younger players, which may lead to gambling addiction in real life.

(3) Gambling should be limited to activities where player skill is the predominant factor in determining the outcome.

(4) This Act clarifies the legal distinction between permissible games of skill and prohibited games of chance.

3. Definitions

(1) Section 3 of the Gambling Regulation Act is amended by inserting the following definitions:

(6) "Game of Skill" means a gambling activity in which the outcome is determined predominantly by the knowledge, judgment, strategy, or skill of the participants, notwithstanding that chance may play an incidental role. This includes games like poker.

(7) "Game of Chance" means a gambling activity in which the outcome is determined predominantly or entirely by random chance rather than by the skill of the participants. This includes games such as slots, coin flips or over/under bets with dice.


PART III — AMENDMENTS TO THE RULES

(1) Section 6. Fair Play of the Server Rules shall be amended as follows:

Participating in, advertising, promoting, or facilitating gambling services is prohibited.
This prohibition does not apply to player-run arcade or casino games games of skill, defined as: a gambling activity in which the outcome is determined predominantly by the knowledge, judgment, strategy, or skill of the participants, notwithstanding that chance may play an incidental role, or activities conducted exclusively in-game or on Discord and not involving real-world currency or external gambling services.

PART III — ILLEGAL GAMING ADVERTISING

4 - Amendments

(1) Section 4(4) of the Gambling Regulation Act shall be amended as follows:

(4) Gambling is allowed in the Commonwealth with the following exceptions:

(a) Where the contest or contingent event takes place outside of the Commonwealth or a recognized foreign nation.

(i) The above exception will not apply if the gambling is in the form of table gaming.

(b) A person must not organize, facilitate, advertise, or operate a game of chance for wagering within the Commonwealth.

Part VII(9) of the Criminal Code Act shall be amended as follows:

9 - Fraudulent Gaming Conduct
Offence Type: Indictable
Penalty: Up to 1000 400 Penalty Units; Up to 60 10 minutes imprisonment
A person commits an offence if the person:
(a) misrepresents or manipulates the odds, outcomes, or terms of a gambling or gaming activity to deceive participants or gain unfair advantage; or
(b) organizes or initiates illegal gambling as defined in the Gambling Regulation Act

Part X(7) Of the Criminal Code Act shall be amended as follows:

7 - Illegal Advertising
Offence Type: Summary
Penalty:
First Offence - 5 Penalty Units.
Second Offence - 10 Penalty Units.
Subsequent Offences - 25 Penalty Units.
A person commits an offence if the person:
(a) advertises a business, goods, or a political campaign in a public chat not designated for advertising; or
(b) advertises a gaming institution or gambling in a public chat designated for advertising.
(b) advertises an illicit service, item, or other form of transaction that is deemed criminal by this act.
(i) This offence shall not occur when it is advertising specifically for a BM's (Black Market's) services in a proper channel.

8 - Illegal Gaming Advertising
Offence Type: Summary
Penalty: 25 Penalty Units; 10 Minutes in Jail
A person commits an offence if the person:
(a) Advertises a gaming institution or gambling in a public chat designated for advertising.
(b) Sends an unsolicited DM, either in-game, or through an external messaging app such as Discord or the DemocracyCraft Forums advertising a gaming institution or gambling.
(c) Drops items directing a player to a gaming institution or gambling.


5 - Renumbering
(1) All subsequent sections and subsections of the Gambling Regulation Act shall be renumbered as appropriate.

(2) All subsequent sections and subsections of the Criminal Code Act shall be renumbered as appropriate.
 

Presidential Assent


This bill has been passed into law. As per Section 24(3) of the Constitution of the Commonwealth of Redmont.

Reason: This Bill is assumed to have been given assent, as per Section 24(3) of the Constitution.

The President has the authority to assent to or veto legislation passed by Congress within 14 days before assent is assumed and the bill passes into law.
