Executive Order 65/26 - Public Execution Procedure

By the authority vested in me by the Redmont Constitution and the Public Execution Act
I, Anton Frontier, President of the Commonwealth of Redmont, do declare the following under this Executive Order:

Whereas, a "President may issue and revoke Executive Orders to ensure good governance of the server" (Const. 24(5));

Whereas, the Public Execution Act adds Public Execution as a penalty for Treason under Part 2 section 4 of the Criminal Code Act, to be carried out by the Government of Redmont or the Department of Homeland Security;

Whereas, the Act does not set out who orders an execution, when it is carried out, or who records it;

Whereas, "all accused are entitled to appeal a charge made against them by the state" (Const. 35(4)), and every citizen has the right not to be deprived of life "except in accordance with the principles of fundamental justice" (Const. 35(14));

Whereas, the President may grant reprieves and pardons to individuals charged with breaking the law (Const. 24(1));

Section 1. Preliminaries

1. The purpose of this Order is to set out how the Department of Homeland Security ("the Department") carries out a sentence of Public Execution.

2. In this Order, Public Execution has the meaning given in section 3(1)(a) of the Public Execution Act, and the Secretary means the Secretary of Homeland Security.

3. Nothing in this Order changes any sentence, limits the discretion of a court under section 5 of the Criminal Code Act, or overrides the Criminal Code Act. Where this Order conflicts with an Act of Congress, the Act prevails.

Section 2. When an Execution May Be Carried Out

1. The Department shall carry out a Public Execution only after a court has imposed it in a final written verdict.

2. The Department shall not carry out a Public Execution until:
a. the convicted person has stated in writing that they will not appeal; or
b. seven (7) days have passed since the verdict without an appeal being lodged; or
c. every appeal lodged against the conviction or sentence has been finally decided and the sentence upheld.

3. The Department shall not carry out a Public Execution while a reprieve is in force, and shall not carry it out at all once a pardon has been granted.

Section 3. Ordering and Scheduling

1. Once section 2 is satisfied, the Secretary shall issue a written execution order naming the convicted person, the verdict, and the date, time and in-game location of the execution.

2. The execution shall be scheduled no sooner than forty-eight (48) hours and no later than fourteen (14) days after the execution order is issued.

3. The Secretary shall give the convicted person a copy of the execution order at least forty-eight (48) hours before the execution, and shall announce it publicly.

4. If the convicted person is not online at the scheduled time, the Secretary may reschedule the execution twice, with fresh notice under clause 3. The Department may use its existing lawful powers of arrest to bring the convicted person to the place of execution.

5. If the execution cannot be carried out within thirty (30) days of the first execution order, the Secretary shall report this to the President and to the court that imposed the sentence.

Section 4. The Firing Party

1. A Public Execution shall be carried out by a firing party of three (3) officers of the Department, each holding a valid firearms licence, under the command of the Secretary or an officer the Secretary appoints.

2. Two (2) officers shall simultaneously attempt to kill the convicted person, and the third officer shall kill them, as section 3(1)(a) of the Public Execution Act requires.

3. If the convicted person is not killed during the execution, the commanding officer may direct the firing party to try again immediately.

4. Members of the firing party acting under a lawful execution order are carrying out a lawful sentence and do not unlawfully kill the convicted person.

Section 5. Recording and Publication

1. The Secretary shall appoint an officer of the Department who is not part of the firing party to record the execution, beginning at least two (2) minutes before the convicted person is killed and ending at least two (2) minutes after.

2. The Department shall keep a copy of the recording and post it in its entirety in the DemocracyCraft Discord #government-announcements channel within forty-eight (48) hours of the execution.

Section 6. Commencement

1. This Order takes effect immediately upon signing.

Given under my hand at the Brown House, this 3rd day of November, 2026,
