Executive Order 60/26 - Departmental Deputy Complement





By the authority vested in me by the Redmont Constitution
I, Theory Fontaine, President of the Commonwealth of Redmont, do declare the following under this Executive Order:


Whereas Const. 24(5) empowers the President to issue and revoke Executive Orders;

Whereas Executive Order 59/26 established both a limit on the number of Deputy Secretaries a department may carry and a requirement that each be confirmed by the President or the Vice President;

Whereas the confirmation requirement drew serious objection, the substance of which was that a power to decline appointments can in practice become a power to direct them, and that nothing in the text of the Order prevented it;

Whereas a power the holder of this office would not wish a successor to hold is not a power this office should keep;

Whereas the limit on the number of such offices rests on separate grounds, being the cost of a general office to a department operating in deficit, and those grounds are unaffected by the objection above;




Section 1. Purpose

1. This Order revokes Executive Order 59/26 and retains, on its own, the limit on the number of Deputy Secretaries a department may carry.




Section 2. Revocation

1. Executive Order 59/26 is revoked in its entirety.

2. No appointment to the office of Deputy Secretary requires the confirmation of the President or the Vice President.

3. No Deputy Secretary holding office on the date of this Order is affected by the revocation, and no such officer is required to seek confirmation of any kind.




Section 3. The Complement

1. No executive department shall carry more than two Deputy Secretaries.

2. The President or the Vice President may approve in writing an additional deputy office for a department where its size or workload warrants it, and may set a period for which that approval holds.

3. A department carries an additional deputy office only for so long as an approval under subsection 2 is in force.

4. An appointment that would carry a department beyond its complement is of no effect.




Section 4. Continuity of Service

1. No person shall be separated from a department by reason of this Order.

2. Appointment to and removal from the office of Deputy Secretary rests with the Secretary of the department, subject only to Section 3.




Section 5. Fiscal Neutrality

1. This Order creates no new appropriation and authorises no new spending.

2. Any saving arising under this Order remains within the department in which it arises and shall be applied to programme spending.




Section 6. Interpretation

1. This Order limits a number of offices. It confers no power over any person holding one.

2. Nothing in this Order limits the ordinary authority of a Secretary to organise the staff of their department.
