Executive Order 23/26 - Work Stoppages
Whereas, a "President may issue and revoke Executive Orders to ensure good governance of the server" (Const. 24(5));
Whereas, Section 29(1)(b) of the Constitution tasks Secretaries with "[c]reating and amending departmental policy in accordance with the President’s direction".
Whereas, from time to time, the President may direct the cessation of work by certain government departments, in the interest of good governance of the server;
Whereas, the Executive Standards Act designates the Department of Health and the Department of Homeland Security as emergency services providers;
Whereas, clarification as to what a government work stoppage requires should be laid out in clear and plain language;
Therefore, by the authority vested in me by the Redmont Constitution, I, Multiman155, President of the Commonwealth of Redmont, do declare the following under this Executive Order:
§ 1. PURPOSE AND INTENT
(1) The purpose of this executive order is to outline what kind of work is prohibited in a work stoppage, the circumstances in which a work stoppage may occur, and the role of emergency services in a work stoppage.(2) Nothing in this Order should be read to imply limitations or endorsements of an individual's or collective's ability to lawfully strike outside of a declared work stoppage; this Order governs work stoppages enforced by the government.
(3) Nothing in this Order should be read to imply limitations on a department's ability to suspend particular employees, with or without pay, in the absence of a declared work stoppage.
§ 2. WORK STOPPAGES
(1) A "work stoppage" shall be a period of time where government employees may not perform work on behalf of certain governmental entities:(a) A "federal work stoppage" is a kind of work stoppage where employees of the executive departments may not perform work on behalf of the federal government, except where such work is necessary.
(b) A "departmental work stoppage" is a kind of work stoppage where employees of a particular department may not perform work on behalf of that department, except where such work is necessary.
(c) Other kinds of work stoppages may be created ad hoc by the president, or by the president's designee, to account for specific circumstances related to the cause of a particular work stoppage.
(2) Work is to be considered necessary when such work is:(a) to be performed by a department designated by law as an emergency services provider;
(b) subject to a statutory or court-imposed deadline that would require the work to be done before a certain date;
(c) required to facilitate elections;
(d) urgently required to perform the core statutory obligations of a particular government department; or
(e) otherwise required by the text of the Constitution.
(3) At the president's pleasure, the president or the president's designee may begin a work stoppage by making a post in #government-announcements, by standalone executive order, or by other public communication. Upon a president's or designee's announcement of a federal work stoppage or departmental work stoppage, all relevant departments must cease all work except the work deemed necessary under §2(1)(a) of this Order, or such work otherwise required by statute or the Constitution.
(4) The president, or the president's designee, may end a work stoppage by making a post in #government-announcements declaring the end of such stoppage.
§ 3. IMPLEMENTATION
This Executive Order shall take immediate effect upon its signing. Any work stoppages declared by the president in the 24 hours prior to the issuance of this Order shall be valid and shall be read in light of this Order.Signed,
