Executive Order 01/26 - DCT-DoC Auction Cooperation Policy​

Whereas, the Department of Construction and Transportation creates auctions in the #realestate channel on discord;
Whereas, the Department of Commerce, in general, oversees #realestate channel on discord;
Whereas, cooperation between the Department of Construction and Transportation and the Department of Commerce for government auctions in the #realestate channel would be beneficial to the Commonwealth;
Whereas, clearer delineation of responsibilities for the Department of Construction and Transportation and the Department of Commerce in the context of DCT-run auctions would be helpful in achieving peaceful cooperation;
Whereas, Section 29(1)(b) of the Constitution directs that Secretaries have the responsibility of "[c]reating and amending departmental policy in accordance with the President’s direction."

Therefore, by the authority vested in me by the Redmont Constitution, I, Multiman155, Acting President of the Commonwealth of Redmont, do declare the following under this Executive Order:

§ 1. DCT-DoC Real Estate Cooperation Policy

The Secretary of the Department of Construction and Transportation and the Secretary of the Department of Commerce are directed to and shall review the following DCT-DoC Real Estate Auction Cooperation Policy, and within 14 days amend or create department policy to ensure that their departments operate consistenly therewith:

DCT-DoC Real Estate Auction Cooperation Policy​

The scope of this policy shall contain auctions of real property initiated by an agent of the DCT within the #real-estate channel (hereafter referred to as "DCT Real Estate Auctions"). The Department of Construction and Transportation (DCT) and the Department of Commerce (DoC) are bound by this executive policy.

The DCT and the DoC each have a role to play in overseeing DCT Real Estate Auctions. While there may be overlap at times, this policy seeks to delineate the role of each department in handling DCT Real Estate auctions.

1. Role of the DCT​

The DCT has the primary responsibility for running DCT Real Estate Auctions, ruling bids as invalid in line with its policies, and collecting payment from auction winners. The DCT may require bids to follow a certain format, have certain proof-of-funds requirements (including location of funds), and otherwise establish reasonable restrictions on participation in DCT Real Estate Auctions that are rationally related to a legitimate government interest.

2. Role of the DoC​

The DoC has the primary responsibility for ensuring that bidders comply with laws regarding financial crimes and investigating possible financial misconduct. The DoC may request proof of funds from bidders in DCT Real Estate Auctiosn and (in general) may apply its #real-estate rules to DCT Real Estate Auctions except where pre-empted or overruled by the DCT. However, the Department of Commerce (and its agents) may not cancel a DCT Real Estate Auction, and the DoC must defer to the DCT when seeking to invalidate a bid in a DCT Real Estate Auction.

3. In General​

Except where otherwise noted, the following rules shall apply to DCT Real Estate Auctions:

DCT Real Estate Auction Rules​

  • Auctioneers may rescind their offer to auction off a plot only in the instance that it lacks bids.
  • Neither auctioneers nor bidders may engage in acts which serve to direct attention away from a bid.
    • Such acts include:
      • (a) commenting negatively on the starting price,
      • (b) commenting negatively on the the rarity or lack thereof,
      • (c) commenting negatively on the utilitarian value or lack thereof,
      • (d) advertising one’s own bid or business on another’s channel; or
      • (e) holding general conversation within a bid channel.
  • All bids are automatically considered to be in Redmont Dollars
  • All bids are legally binding and all bidders are obligated to uphold their stated bid.
    • Bidders may not, at any time, modify their bids for any reason.
    • In the instance that a bidder fails to pay, the DCT may take administrative action against the bidder.
  • Users may not bid any more than is currently in their personal, company, or bank balance.
    • Should an individual wish to bid via an alternate account the player must state the source of the funds. (i.e Bank, Company, Other Form).
      • The DCT and DoC each reserve the right to request proof of funds.
    • In the instance that a player's balance is at the required threshold but falls below it by the time of the auction's end, the next highest bid is the default winner.
    • In the instance that a player wins an auction but is deported/leaves from DemocracyCraft itself, the next highest bid is the default winner.
  • Bidders may not raise their own bid when their bid is the highest valid bid.
  • The DCT may establish additional rules regarding DCT Real Estate Auctions outside this ruleset, but must make known such rules at the time an auction begins for such rules to be enforceable.

§ 2. Repeal of out-of-date executive order

Executive Order 1/04 - The Mao Administration is hereby repealed.
