COMPLAINT

The Plaintiff complains against the Defendant as follows:

Senator ToadKing is currently sitting in the Senate without the practical capacity to participate in congressional proceedings, thereby undermining the function of the Senate and his representational duties.

While there is no longer an express requirement for Discord to run for Congress, there is certainly an implied requirement.

Congressional business is conducted exclusively through the official Congressional Discord. Without access to that forum, a Senator cannot meaningfully participate in the legislative process.

In fact, although the records are incomplete because some channels were later deleted, there is a known prior example. When Vernicia left the Congressional Discord several years ago, a vote of removal was initiated on the basis that she was not present to carry out her duties. That vote did not proceed only because she rejoined the Discord.

There is an established expectation that congressional members must be part of the Congressional Discord in order to participate in the legislative process. While the Constitution no longer states this expressly, participation through the Discord has consistently been treated as necessary in practice.

II. FACTS

1. Toadking is an incumbent Senator.

2. Vernicia was previously subject to removal as a member of Congress for leaving the Congressional Discord.

3. Congressional debate almost exclusively takes place on the Congressional Discord.

4. Congressional motions almost exclusively takes place on the Congressional Discord.

5. Congressional presiding officer elections exclusively take place on the Congressional Discord.

6. ToadKing currently partakes in Congressional duties vicariously through other members of Congress.

7. ToadKing is unable to access Discord for the foreseeable future.

III. CLAIMS FOR RELIEF

1. Lack of Capacity to Hold Office —
A sitting Senator must possess the practical ability to perform the core functions of their office. Senator ToadKing’s inability to access the forum that congressional business takes place renders him incapable of fulfilling his constitutional and statutory duties.

2. Breach of Constitutional Principles of Representative Government — A Senator who cannot participate in legislative proceedings undermines the principles of representation, deliberation, and accountability required by the Constitution.

3. Failure of the Commonwealth to Enforce Eligibility and Capacity Standards — By allowing Senator ToadKing to remain in Congress, despite his inability to participate, the Commonwealth has failed to ensure that Senate seats are occupied by members capable of discharging their responsibilities.

IV. PRAYER FOR RELIEF

The Plaintiff seeks the following:

1. The court finds an implied requirement of Congressional discord patronage in the Constitutional requirements of being a member of Congress to fulfil their Representative duties.

By making this submission, I agree I understand the penalties of lying in court and the fact that I am subject to perjury should I knowingly make a false statement in court.

Some points of clarification based on public discourse coming out of the legal channel —

This case essentially seeks judicial review over requirements to fulfil an elected office in a representative democracy through implied requirements of fulfilling those duties [as a member of congress].

If an implied requirement is found, then the individual in question is holding an office which the constitution requires them to have higher qualification for [access to the congressional discord].

Therefore, its SCR original jurisdiction because a favourable verdict would result in the removal or disqualification of a sitting senator. An implied requirement to hold office would render that Senator ineligible unless they were able to get access to Discord and subsequently the congressional server.
