Prohibit the theft of Passports and other licenses

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the 'Documentation Theft Act.'
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by Avaneesh2008.
(4) This Act has been sponsored by Representative TrueDarklander.
(5) This Act has been co-sponsired by [congressperson]
2 - Reasons

1. Passports and other physical documents can be stolen and the punishment should be more than normal theft
2. There are situations where entities or individuals may refuse to give back passports or other documentation that an individual gave to them for legitimate purposes.

3 - Provisions

1. The Criminal Code shall be amended as follows:

“11 – Documentation Theft
Offence Type: Summary
Penalty: Up to 50 Penalty Units and 60 minutes imprisonment, in addition to mandatory restitution of the item(s) or their value and fees incurred in replacement of any documents.
A person commits an offence if the person:
(a) Has in possession another individual’s passport or personal documentation without the legal authority in doing so with or without permission from the individual. A person won't commit the offence if they:
(i) take a personal document from the player with their permission to check the identity of a player or verify the license of a player before promptly returning the document back to the individual.
(ii) were given the document without their knowledge by an individual or found the document and upon realization, promptly either returned the document back to the individual, mailed the individual the document, or returned it to the Department of State
This offense overrides theft.
