Amend the Constitution​

The people of the Commonwealth of Redmont, through their elected Representatives in the Congress and the force of law ordained to that Congress by the people through the constitution, do hereby enact the following provisions into law:

1 - Short Title and Enactment
(1) This Act may be cited as the 'Dereliction Fix Part 1 Act.'
(2) This Act shall be enacted immediately upon its signage.
(3) This Act has been authored by Representative zLost.
(4) This Act has been co-sponsored by Representative RealImza.

2 - Reasons
(1) The Constitution needs to be amended to allow Representatives to be punished for Dereliction.
(2) If a representative commits dereliction, the Electoral Act allows them to be removed with a simple majority. However, the Constitution requires 4/5th of the chamber to remove a congressmember, and therefore overrides that clause of the Electoral Act.
(3) Note: Dereliction is already defined in the Legislative Standards Act and the clause being added to the constitution is already present in the Electoral Act. This Act only seeks to fix the contradiction between the Electoral Act and the Constitution.

3 - Amendment
Section 11 of Part 1 of the Constitution will be amended as follows:

11. Removal of Congress Members

(1) Representative Removal. A Representative can be removed from Congress early by the relevant presiding officer with the consent of four fifths of their chamber (excluding the individual in question).

(2) Senator Removal. A Senator can be removed from Congress early by the relevant presiding officer with the consent of all members of their chamber (excluding the individual in question).

(3) Removal shall only require a simple majority if the individual in question has committed dereliction of their duties.

The following will be added to Part 7 of the Constitution:

49. Dereliction
A Congressional Member will be deemed to have committed dereliction of their duties if they fail to vote on 5 or more bills/motions which fail due to not meeting quorum, or fall below the playtime required to vote in elections. Changing the definition of Dereliction will require four-fifths majority in Congress.


Current Sections 49, 50, and 51 of the constitution will be re-numbered 50, 51, and 52 accordingly. The heading "49. Dereliction" will be colored and bolded like this.
